OFFICIAL RULING FROM THE NYS DEPARTMENT OF HEALTH:
Dogs or any pets for that matter are NOT allowed in ANY food establishment. Period, END OF STORY.
I'm working on getting the link to the actual code itself.
Yes, I felt the need to give this it's own thread.
Maybe now, people who feel the need to bring their "doggies" into a supermarket will not.
If you DO bring YOUR doggie into ANY food establishment, you ARE breaking the LAW.
Have a nice day!
Jenn - when I said this yesterday one person responded that it doesn't matter because SUFFOLK says that they are allowed in. Am I right that state law trumps county law?
yes you are 100% right

NYS Department of Health. I called them.
As for CA. I would think the CA State Dept. of Health or something similar of the sorts.

Oh okay. I thought maybe I could find something online about it, but I searched the CA department of health website a little and couldn't find the answer.
Thanks!

We were discussing this the other day. It is like there is an overwhelming sense of individual entitlement that really has no place. It has truly become a Me world.
I agree completely. So many people feel they are entitled and that the rules don't pertain to them. I see it all the time under varying circumstances.

I believe county law trumps state law but I could be wrong. Either way, for those stating that Suffolk County allowed pets in food establishments, you're wrong...unless you're referring to fish.
Source
Except as specified in (a) and (b) below, live animals shall not be allowed on the premises of a food establishment. a. Live animals may be allowed in the following situations if the contamination of food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles cannot result: (1) Edible fish or decorative fish in aquariums, shellfish or crustacea on ice or under refrigeration, and shellfish and crustacea in display tank systems; (2) Patrol dogs accompanying police or security officers in offices and dining, sales, and storage areas, and sentry dogs in outside fenced areas; (3) In areas that are not used for food preparation and that are usually open for customers, such as dining and sales areas, service animals that are controlled by the disabled employee or person, if a safety hazard will not result from the presence or activities of the service animal; (4) In areas that are not used for food preparation, storage, sales, display, or dining, in which there are caged animals or animals that are similarly restricted, such as in a variety store that sells pets or a tourist park that displays animals. 72 b. Live or dead fish bait may be stored if contamination of food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles cannot result.

This is verbatim from the FDA rules.

The last two pages of this PDF address the animal rules.

you know what? that official info probably will NOT stop the posters who say they bring their dogs into stores with them at all---something tells me they will say "well thats great but i don't see it as a problem because MY DOG is very clean and will not touch a cart cause i hold them in my arm/carrier/bag"
you're unbelievable. the "posters" that did bring their dogs into the stores have not gone into stores that had signs that said "no pets allowed" there are plenty of places nowadays that let your dogs in it. especially in the city. but whatever. think that we're "inconsiderate" and have no "common sense"

just so you are aware...according to the law, even IF there is no sign, you are breaking the law if you enter an establishment that is listed under the law with an animal.
the restaurant/food store would be in violation of the health code, even if no one in the store is enforcing it.
and if anyone called to complain, the estabilshment would be in trouble

Like someone posted, you are showing us that you still don't get it. Regardless whether a sign is posted or not to go to a store that serves or sells food.
You don't need a sign. PERIOD!

but technically, you ARE breaking the LAW. Whether there is a sign posted or NOT.
There's no way around it. You could have been fined for bringing your dog into the supermarket when you went to get dog food that night.

I didn't know stores needed signs to say no dogs allowed, I imagined that was just common sense. Kind of like "no shirt no shoes no service" signs they didn't mention anything about pants but I still wear them when I shop.

whats unbelievable is someone saying "well they don't have a sign that says its NOT okay" that's the rationality that a 6 year old says when they are caught doing something wrong "well no one TOLD me i couldn't"
like others said--its common sense. bringing your dog into the supermarket just cause you're too lazy to go home and drop them off and come back (god forbid you have to prioritize)---shows your lack of common sense. you say 'well they don't have sign" big effing deal.
so i guess cause theres no sign saying your dog can't crap on the floor---thats okay too

You know where someone mentioned that there was no sign about licking.... so she was going to do that to her DH at Stop & Shop?
eta. You know on second thought...that may actually prompt my DH to do the shopping.

no, it's not a common sense thing if other places allow it. like someone said, in suffolk county it's not against the law. so I simply was not AWARE that it's against the law. that's completely different than KNOWING and still going in.

you act so condescending yet I don't believe you're any better than me or anyone else. get over yourself.
Like I said last night, I wasn't lazy, I had no choice. I couldn't go home otherwise the store would've closed. It didn't bother anyone
