Yes, they might, and you also wont be covered under FMLA for not working there long enough before maternity leave. But, what other choice is there other than being unemployed for 9 months? Good luck!

You won't be covered for FMLA because you have to work there for a year to qualify
But I guess if they fired you at that point, you could get unemployment!

Isnt it illegal for someone to fire you JUST because you were preggo?

Technically, yes, but at my job we can fire anyone for any reason within the first year. We actually don't even legally have to give a reason, and HR recommends that you give no reason so that the person cannot sue.

I'll be honest; you may not have any choice, but my job has had to be flexible with me having morning sickness and leaving for doctor appointments. I cannot imagine starting a new job while facing all of this. I have literally ran out of meetings because I felt so sick, so I told my boss early on. Luckily he is very understanding, but if I was new, and didn't explain the crazy behavior, I am sure it would be a different story.

I hear ya'- but I mean if she felt it was because of her pregnancy and could prove that up until that point she had never been spoken to about poor workmanship and they clearly replaced her (therefore it was financial reasons)
Wouldnt she have a case????
Im just curious...

No--the contract where I work (for the state, by the way) says you can be let go at any point during the first year, with no reason given. They can give some BS excuse like reorganization, blah, blah, but you wouldn't have a case, even if it was due to PG. During the first year they don't have to go through the channels of documenting poor performance/tardiness, etc. It's a way of streamlining that process when you see any signs of poor behavior.

Why did I think this was illegal...
I mean- Ive been at my job for 18 months. I was the 1st employee, there before the school even opened.
When I tell my boss, she can decide that she no longer wants me working there, and thats it???
I have all HIGH scores on my performance reviews, and have rec'd several raises to the highest percentage given.
As far as I know- at my job we dont NEED a reason to fire you either...

NY is at At Will state, they can terminate you at any time.
I got fired at 38 weeks pregnant and everyone told me to file a suit against them. As it was a small company, and they never had performance reviews, and i had never had any warnings, I decided against it.
But I believe that if you got fired at this point, you could prove it.

Since you've been there longer, you have more of a leg to stand on. It is illegal to discriminate for being pregnant, yes, plus you have good reviews to back yourself up. But in a situation where they don't have to give a reason (that my contract lays out for the first year), you can't really argue discrimination because it could be another reason, since they don't give a reason. And at that point there are no performance reviews.

That is the catch 22! It's like gender discrimination. You may feel it, but it is VERY hard to prove.

With at-will employment, a person can be fired for any (legal) reason. A person cannot be fired b/c she's pregnant. While an employer may not have to give an actual reason when terminating a person, if someone filed a lawsuit, the employer would have to give a reason at that point. Presumably, the employer would come up with various reasons why it wasn't a "good fit." It's very difficult to prove someone was discriminated against and/or fired b/c of pregnancy.

Re: probably getting a head of myself.
if you are a nurse and are going to work in a hospital i seriously doubt you will lose your job because of a pregnancy. On my unit, they hire woman all the time that are halfway thru their pregnancy when they start. don't be discouraged.
