need a tenant, apartment listed on MLS... i need to VENT!
so we bought a legal 2 family with the hopes of my sil renting the apartment... needless to say it fell through and were stuck with no renter and are boarderline desperaite... we thought we'd get alot of hits on it and we didnt.
so we called our REA who happens to be my dh's cousin.. and she said to list it on MLS that way we can get credit check and background checks...
now im oblivious to this whole process ive never even rente an apartment before.. but now shes saying that we cannot determine who lives in the apartment. even if we dont like the people we dont have a choice thats part of what goes on once you list it... while im completely unhappy with that we just really dont have a choice and dh doesnt think putting in on craigs list is an option neither do i.
UGGGGGGH THIS REALLLY STINKS!!!!
ANyone know someone looking for a 2 bedroom apartment?!

I have a broker that I can refer you to? He's gotten tenants for my LI house for the past 5 years. He's excellent and you don't have to give him a penny, no contract and you don't owe him anything if you rent it on your own!

thank you ladies... i do have a rea im working with its our cousin whos listed it so i do trust her. i just feel like if trash walks in i dont have a choice kwim??

Why not craigslist? We found our old apt on there.... ive even got tons of jobs off of there... I think its a great source!

Sure you can! why couldn't you credit/background check them? The cost is minimal or you can put it in the ad on craigslist and have your REA do the checks for you.

get the F out... so im freaking out for no reason??!?! she told us that if a 4 young guys walk in and want to rent it and after we've met them, that we cannot discriminate and say no, but we do have a right to meet them.. (my husband would only say no because he'd be afarid they would be parting and keeping my dd up)

I had tons of people view our houses and there were some that I just said no to. No one questioned anything. some weren't credit worthy, some were just not what we were looking for. (for example a family with 3-4 kids and aunts/uncles/
BTW, i'd rent to 4 guys ANY day. I had 4 guys renting my LI house and they were the best tenants. each had their own lives and were hardly ever there really.. always either working or with their GFs. also, rent was always on time. the way I look at it, if one guy can't cough up the rent, the other three will most likely get on the guy to get the rent or will settle it with him directly to make sure that YOU get your rent.
whereas if it's a couple, if one is a$$ed out, usually there's nothing that can be done about it.. only you waiting around for it.

I don't understand this?  How can you not have a choice on MLS? So the first person that is interested in the apartment gets it? That makes no sense at all. And you can do a credit check online for a small few. My MIL does this all the time. And I would think you have the right to call their employer to find out if they really do have a job. I would double check with your REA and ask her to explain again. Or ask another REA for info about this just out of curiosity. KWIM?

we live in a 2 family and are going through the same process. We were a bit shocked to find out about the discrimation laws and how we don't have much of a say in who will live upstairs. We can't even comment on how many people can live upstairs beyond legal limits. I agree, it is really disturbing and I freaked out just like you.
I spoke with a friend who is a RE. Apparently REs can phrase questions - legally - in such a way as to try and weed out the less desirable elements. In addition, the credit/background checks also help bring in the good tenants.
Be careful, know the laws, and good luck!

i just want to know that if iget a werid vibe from someone and i just flat out dont want to rent to them i want to be able to say NO! end of story.

don't do an MLS listing
go on craigslist...take some pics of the place, make an ad, post it - if it's a decent apt tons of people will call - trust me (i did this twice so far for my old apt - my in-laws don't know how to use the computer so i did everything but interview for them)
have as many as you want come see the place - that is when you get to interview them - if they are interested in the apt & you like them at that point you can do a background check/credit on our own...
you can 100% choose who you want to rent your apartment - but you CANNOT discriminate b/c of race, religion, etc b/c that is illegal - but you can choose your tenant based on compatibility and your comfort level with them if you are interviewing on your own (as far as i know)....
it's the same as a job interview - employers can't discriminate but they certainly interview and chose the best person for the job KWIM?
craigslist worked twice when i rented out our old apt...both times my in-laws had tenants within 1 week...first time they rented to a young cop, this time they are renting to a young couple...they have been happy with their tenants both times...
my in-laws always told people who came that they were still doing showings - so people knew that they had competition 
so far they haven't gotten into legal issues over it - nor have they discriminated against anyone in any way...they just picked the person they felt most comfortable with...

just listed a couple of weeks ago (we have a 3 bed apt). Have had 2 showings. One person wanted more than we were okay with (unlimited use of the backyard - the apt has a private outdoor deck, but the backyard is our space).
The other person seems really great and we're hoping she's interested.
So I guess, good luck to us both!

The discrimination laws do not apply when it is an apt in your private house like they do to apt buildings. You absolutely can say no to anyone who walks through the door whether or not they come to the apt through a RE.

This is how we found the house we are in now ,was through the CL ! They went throught a REA ,and we paid the fee . Best thing ever was the REA !
