Because this is the internet and when you post something on a message board, you open yourself up to comments. Based on the way you wrote your post, you left out the key piece of info that the rummager made a mess even after you left the note. Without that info, it sounded like you were being spiteful. After you clarified, I apologized and I sincerely mean it. Get over it.

I'm starting to think you are the miserable garbage picker.

Re: I cant believe the ball$ on this person

OMG what happened? did you file the report? they should patrol the area to at least get a plate or description or you should take pictures so you have something to go by if in the event they do something to your property

Re: I cant believe the ball$ on this person

OMG I don't even know what to say. I would def. call the police - in fact, I would have probably called the police the moment I saw someone rummaging through my trash - the idea of it just makes me feel unsafe. flame away... Where do you live? I can't imagine this going on....DEFINITELY call the police - this person sounds INSANE and now they obviously have it in for you. You should talk to your neighbors as well since it seems they are getting the same treatment - maybe a patrol car can sit outside and this person can move on.

Since it is ILLEGAL to take cans out of the recycle bin would you have any compassion if this person stole your purse because they are down on their luck because that is illegal too. What gives someone the right to act like that just because they are having a hard time?? And to have to deal with that at you own home!! Call the police!

I tried to look this and got nowhere... Not in Suffolk Co. or in a few towns... I couldn't find links to the laws anywhere. Frustrating, in whatever instance you might want to look them up.

Since when is it illegal? you see people collecting cans and bringing them to recycle centers all the time.

i posted a related post on the home boards last week about people going through my recycling bins, and everyone pretty much said it was accepted for people to do that and it happens all the time. I don't understand why it would be illegal?

Wow

I think the note from the recycling bandit was totally out of line, but he/she is probably in a really sh!tty mood since they have to dig through garbage to make ends meet.

Obviously I am in the minority, personally - I would not call the police. Nor would I confront the person.

Yes, he/she is offensive.
Yes - he/she made a mess.
Yes - he/she has an attitude.

But really... in the grand scheme of things, is it THAT big of a deal to sort the cans & leave them for them? It would be your "good deed" for the week. Who knows, maybe next time you'll get a thank you card.

I got a laugh at that as well.

I have never had this problem because I return the cans myself. Another argument for the frugal lifestyle. Chat Icon I would call the cops too, though. This woman does sound unstable and even if the police can't do anything at this point, I would want documentation of her actions.

It has something to do with once you put the garbage/recycling you surrender ownership and it becomes town/city property. That's why law enforcement can go through trash without warrants. I dont think anyone wants to give a ticket/citation to someone rooting around for some extra money by returning bottles or recycling an old table.

I know for me, yes it is a big deal. Personally, I don't have time to sort through my recycling. I have two bins, one for newspapers and one for cans/bottles/glass, etc....I'm not going to go out of my way in case someone wants to go through my recycle bins. Besides which, they are on MY property, and that would be trespassing.

To the OP... I would definately not confront this person again, and if it happens again, I would call the police. Chat Icon

The reason why cops do it without a warrant is because it's on the curb, not on the owner's property. Which mean they don't need a warrant. It's fair game on the street.

The issue here started is that the person made a mess and spread the trash over the lawn to get to the cans not because the person was taking the cans.

A car is parked on the street but it doesn't give the cops the right to search it without a warrant. I used to know someone that worked code enforcement for sanitation and we got into a big debate about this issua a couple years ago - that's why it stuck out.

I was just responding to the illegal issue - I am aware that the OP was upset about garbage/recycling being thrown all over her property.

Re: I cant believe the ball$ on this person

Ok, wow. I wont take this to the police, I did however ask a friend who is a cop for some advice. The note was not threatening, she made no mention of actually hurting my family or myself. She does have a right to go through the garbage which is on the curb, had she gone on my drive way and gone through my trash then that would be trespassing.

As I stated I had NO PROBLEM with anyone taking the deposit cans, but i'm sorry I flat out refuse to sort my garbage out again because this woman refuses to clean up the mess she made on my lawn, especially after she was rude and disrespectful when I asked her nicely to not leave the garbage out.

I also will not confront this person, but count on 2 things, cans will be crushed still and garbage will be brought out when the truck turns onto the block
