FMLA and bed rest
If you have to stop working before the baby comes to go on bed rest, do the weeks spent on bed rest count towards the 12 weeks of FMLA?

I would double check with your hr company since if you are on bedrest aren't you out on a medical disability.

The simple answer is yes... however, if your employer lets you work from home while on bedrest then it wouldn't count towards FMLA.

For me it would not. FMLA is leave to take care of a family member. If I was on bedrest it would be short term disability. for me maternity and FMLA did not kick in until I had a baby in hand.

Yes, I found out when I thought I had 6 weeks of FMLA left when I only had 1 week! Good Luck with the bedrest.

Yes, it is part of FMLA.

FMLA is actually leave pursuant to
the birth of a child and to care for the newborn child
or placement of an adopted or foster and to care for the newly placed child
or to care for the employee’s spouse, child, or parent with a serious health condition
or for the employee's own serious health condition that makes them employee unable to perform their job...
So any leave taken prior to the birth of a child would be considered FMLA unless you're also able to work from home. Although, some employers aren't sticklers about it and will let women still take off the full 12 weeks even if they were out on bedrest before the baby was born.

Yes, any time away from your job counts towards FMLA even if it's before you actually have the baby.

Yup - you can only take 12 weeks off in a calander year. Any consecutive time off counts toward the 12, so bed rest is included

This I was on bed rest for 4.5 months before DS was born. It counted towards my FMLA

I stopped working at 26 weeks bc I had twins. My dr was very strict with this. He wrote a note and I filled out some ppwork with HR. I was on disability until I gave birth and then my FMLA kicked in. So I was able to stay at home 12 weeks after my sons were born.

It counted for me. I was on modified bedrest from 20 weeks. It used all my FMLA. Then when I had my DD I was allowed off the NYS disability of 8 weeks for a C/S , but I resigned anyway.
