Diane Schuler's husband suing state, brother-in-law over wrong-way Taconic crash
This is so sad. He really needs to concede to the fact that his wife was drunk and high and kill his three nieces and their own daughter.

The husband of the woman who killed herself and seven other people in a wrong-way crash on the Taconic State Parkway is suing the state and his brother-in-law, whose three daughters were victims, the New York Post reports today.
Daniel Schuler filed a lawsuit Monday against the state in the New York Court of Claims, arguing that the highway was poorly designed and lacked signs.
He also filed a separate suit last week in state Supreme Court against his brother-in-law Warren Hance, claiming that because Hance owned the car his wife Diane was driving, he is "vicariously liable."
Diane Schuler, her 2-year-old daughter, Erin, and her nieces Emma Hance, 8, Alyson Hance, 7, and Kate Hance, 5, died in the July 26, 2009, crash, as did the three occupants of the SUV: Michael Bastardi Sr., Guy Bastardi and Daniel Longo of Yonkers.
Daniel Schuler has contested accounts that his wife was intoxicated and high at the time of the crash.

What a pos to sue her brother who lost his 3 kids due to his wife's irresponsibility. I am sure her brother wishes every day that he didn't let her borrow his van. Now I completely believe the husband knows more than he will ever tell

I am sure that man would take back lending his van, her accessory to the murders, anyday. What is wrong with him?
There was NOTHING wrong with the van. There was SOMETHING WRONG WITH HIS WIFE (which he clearly is in denial about).
Face it dude, whatever her reason, she drank booze and had pot before driving. Accept it.

Ugh, that is an incredibly horrible move on his part to sue his BIL, the brother of his wife who killed his 3 nieces. Horrible, horrible, horrible.
It's one thing to try and continue to find a way to explain what happened. The explanation he was trying to prove about a mini stroke causing delusions which made her mistake the vodka for something else... as far fetched as it was, I couldn't be mad at him for trying to make this connection. For trying to prove that there was an explainable medical reason for her to chug the vodka. I couldn't blame a man for trying to make the memory of his dead wife and mother of his living child a little better than the monster everyone is making her out to be.
But this is completely unacceptable and disgusting for him to do this to his BIL. I'm sickened over this. I actually have less sympathy for him than I do for Diane Schuler. The families are already destroyed, he is continuing to destroy them even further. I feel so badly for his son.

In re: to suing the state, wasnt there a few other accidents stating something was wrong with this road? I am just curious if he can get in on a larger settlement with others that had an accident on this road. This is NOT to say that his wife wasnt high and intoxicated bc that in itself should do him in with this claim. Where he even gets off. Its like a drunk driver hitting a median and saying "well it wasnt supposed to be there". What an azzzzzzz!!!!!

My assumption would be that if you take away the familial relationship and the fact that they were in the car with the driver at fault - if they were killed by a different car accident the legal interest would be to go after the driver and/or the car owner.
Don't know if I'm expalining it right. And really it's not right to do that. It's all just so wrong.

If he hasn't - I don't think he can. Articles were saying any lawsuits needed to be in before the 2 year anniversary...so that's why some were filed yesterday.

I also read this....
Jackie Hance wrote in Ladies' Home Journal that the Bastardis have sued them for the crash, "By some horrible irony, Warren could be taken to court. While everything that mattered was already gone, everything that remained could still be taken."
This poor family Praying that they have a healthy baby that helps to somehow take away some of their devastation.
