Can someone clarify this for me...

I took dd to the drs and the nurse told me that kids CAN NOT be in the front seat that are under 16 and if found in the front seat there is a 500 dollar fine...is this true? I pick up my dd and my friends 3 kids and the oldest is 11. i put the 11 yr old in the front assuming that it was okay bc I could have sworn it was okay when I was younger...hmmm.... so what is the true answer?

Highlights of New York State's occupant restraint law:

In the front seat, the driver and each passenger must wear a seat belt, one person per belt. The driver and front-seat passengers aged 16 or older can be fined up to $50 each for failure to buckle up.
Every occupant, regardless of age or seating position, of a motor vehicle being operated by the holder of a Class-DJ Learner Permit, a Limited Class-DJ, or Class-DJ Driver License must be restrained by a safety restraint.
Each passenger under age 16 must wear a seat belt or use an appropriate child safety restraint system. The restraint system must comply with the child height and weight recommendations determined by the manufacturer. Depending on the size of the child, the restraint system may be a safety seat or a booster seat used in combination with a lap and shoulder belt.
The driver must make sure that each passenger under age 16 obeys the law. The driver can be fined $25 to $100 and receive three driver license penalty points for each violation.
Seat belt use is not required in taxis or livery vehicles, emergency vehicles, 1964 or older vehicles, or by passengers in buses other than school buses (seat belt use may be required by the school district). Rural letter Carriers are also exempt while they are delivering mail.
Tip: Keep your seat belt tight but comfortable.

Wow, Ive always heard the back is safest but never thought they could fine you. What about a truck with no back seat??

When I drive my stepdaughters anywhere (and everywhere!) the 16 yr old always sits in the front, and the 10 yr old always sits in the back!

She said emergency situations only....I asked her that question. But whose constitutes an emergency?

I dont know if I am missing it but it doesnt state no under 16 yr olds in the front seat, does it? Just that they must wear a seat belt.

Yeah which means the 16 and under crowd needs to wear a seatbelt from the other paragraphs or you will get fined the above. Correct or wrong...LOL

I believe the nurse is mistaken. I dont see any where where it states that you have to be a certain age to sit in the front seat...it has been recommended for years that children under the age of 12 sit in the back b/c of the airbag..but its never been a law...

Its kind of like the CarSeat thing. Babies have to be in a carseat..its the law..but its a recommendation that they stay rear facing until a year..

Im trying to find something that states otherwise but I keep getting to real technical legal mumbo jumbo...

Here is the new New York State's occupant restraint law.

It says front seat passengers aged 16 or older so you need to be at least 16 to ride in the front seat with this lawChat Icon

Just FYI...in regard to your second paragraph...I was told that its the law that they must be 1 yrs old and 20 pound to turn the baby around. Not a recommendation. Thats why this week my dd can finally be turned and not have her legs all crushed up beyond belief sitting backwards.

No..what this is saying is this....If the front seat passenger is over the age of 16 the passenger would get the fine NOT the driver...

This happened to a friend of mine..they both got fined for not wearing their seatbelts..the driver and the passenger...

I believe to sit in the front seat, you must be either 14 years old OR whatever the weight is, let's just say 80lbs. for argument's sake. I know that when we go on field trips and the teachers have to drive, we are only allowed to put 8th graders who are 14 in the front seat.

It talked about fines in that sentence so I just assumed that if you were under 16 and werent obeying the law your parent would be responsible and if you were 16 and over then you would get the fine.

I am reading it to mean you have to be 16 to sit up front.

See, I just see that as saying that the passenger under 16 will not be fined if not wearing the seatbelt, then the driver will only be fined.
