Ahhhhh Neighbor + Fence =?!?!?!?!?!
So, DH and I bought our house about a year ago. We had a chainlink fence, with one side down, so we did not have a yard at all. Being a corner property, we fenced in one side to make it our backyard.
On that side, there was a big tree and a small tree. Since we did not have a fence there at the time, my neighbor had a chainlink fence that made the trees come on our property.
Last week, DH asked the neighbor if she would like to give him $500 towards the new PVC fence. She said no, Idont have the money, payment later was not what she wanted. So, DH said ok, if my fence guy has to take down your fence, I'll let you know. NEXT DAY, SHE TOOK DOWN THE FENCE!!!!!
Fence man comes, looks at the survey and said, these fences are all wrong, you had too much of her property. The tress are said neighbors and mine, but MORE hers. Being the fence was there since the development of the houses, I JUST assumed they were mine.
So, since it was a large oak, the fence man put my fence on the inside of the tree, more onto my property. BEING she took down her fence, she now has about 4 inches of my property, which came with a tree and some bushes. Her other fence came up a little short and does not meet our fence anymore, my DH is offering to fix this for her FREE of charge, but she won't answer her bell now!!!!
Are we at fault? Of course I will take care of the tree if anything should happen, but why did she take her fence down in the first place?!?!?!?!?
Thoughts, experiences...calm my nerves lol!

Fences are sticky. When you put up a fence, you need to leave some room on the opposite side of the fence in case you need to fix it from the neighbors side (so you aren't on the neighbor's property).
Second you need a formal acknowledgement from her that the fence allows for x feet of your property on her side of the fence. Why? After a certain number of years, if no one is acknowledging the property line, she can take possession of it, which would shorten your property (adverse possession)

yes this is so true. also if any damages or someone gets hurt its your property also if its her tree and you need to take it down its going to be prob best to have your land surveyed before doing anything.
