Renting a house- Question about Oil

My parents are renting their old house to my BIL and SIL. My father installed new appliances in the kitchen and got a new oil burner.

The tenants are responsible for all utilities and have the insurance in their name.

When they moved in yesterday, the oil tank was empty.

My SIL was pis*sed and said it's "customary" for the landlord to leave a full tank (no one has lived in the house for over a year).

I've tried googling and from what I see- if they start with a full tank, they need to leave a full tank when they move out.
If they fill the tank themselves, they should be reimbursed for what they leave in the tank at the end of the lease.

Anyone have any input?

My house here in LI is oil and I NEVER filled the tank for my tenants.. that is their responsibility..

If the utilities are the tenant's responsibility, then the tenant has to make sure the oil tank is filled if they want to use oil! The landlord isn't obligated to fill it up front. I've rented whole houses and I've never heard that it is "customary" for the landlord to do so.

If oil is not included in the lease then its NOT the landlords responsibility. I rented a house once and we filled the tank when we moved in. Not sure why she would think your parents should fill the tank.

We rent a house. When I moved in the oil tank was empty. My landlord filled it the day we moved in and said when we move out we have to leave it full.

I've never heard that before. I would tell your SIL that this falls under the same category of renting a car or a moving truck. You have to fill the gas up to the amount that you started with. So, if there is nothing there, then she can leave nothing. If there was a full tank, she'd need to leave a full tank when she left.

When we bought our rental house, we switched over to gas becuase we didnt' want to deal with issues about running out of oil, etc. BUT our tenants pay for ALL of their utilities and if we had OIL, they would be paying for that too! It is not customary to provide free oil!

The house we rent now has gas heat, but all of the places we looked at the tenant was responsible for filling up the oil tank if utilities weren't included.

There was one house we looked at in Bellmore that the landlord was throwing in a 3/4 full oil tank, but that wasn't standard.
