Walmart reported them, they didn't taket the children away. The state saw something wrong with the pictures too. I don't think the photo clerk set out to ruin anyone's lives. I feel bad for what they went through but it seems the pictures were more than just bath tub shots.

Yes, but WALMART didn't take the children away. The Wal-mart employee reported something that it is obligated to report. CPS made the determination that this was worth investigating and that the children needed to be removed from the home during the course of the investigation. Clearly they felt this was worth investigating further.

While it does seem to be innocent, I still find it strange that the family had so many naked pictures of their children, including full body nude pictures of children as old as 5 years old? Maybe I am in the minority, but I can see how multiple full body shots of naked 5 year olds could raise some eyebrows. I'm not saying they did anything wrong - I just understand how someone would think this is worth reporting.

I know that Walmart reported them, and it wasn't Walmart that took the children away......maybe I misunderstood what you were saying, I read your post as the couples children were not taken away from them.

I posted on another page, that I see both sides. I think it was great that the employee was looking out for the welfare of the children, but I do think that it was taken too far, and as a parent myself, I feel AWFUL for what those childrens parents had to go through for what THEY thought were innocent pictures of their kids. I have tons of bathtime pictures of my DD (granted, she's not 5 years old). However, my MIL has pictures of my nephews in the tub together - they are 5 & 3, I see nothing wrong with that, she bathes them together because it's easier and more time efficient (if I had 2 kids close in age, I'd do the same thing). Sometimes they are doing something cute, so my MIL snaps a couple of pictures.

CPS tries not to remove kids whenever possible. I think the pics must have been more than innocent bath pics for them to remove the kids from the home.

Can people be added to a sex offender registry before they are convicted of a crime? I was suprised by that.

I saw this on GMA this morning and, honestly, I was horrified. I think the whole thing was blown WAY out of proportion. The kids being taken away from their home for a whole month, the mother losing her job for a year and the parents being on the sex offenders list is just over the top.

Whether its right or wrong, many parents take pics of their kids at bath time. My friends and family members have them. I have even seen people on FB post them. Do I think that it's right to put your children at bath time on the internet? No. Should they have their children ripped from their homes and be labeled sex offenders? I would think not.

This article and video made me sooooo mad and sad for this family , I am on the verge of tears . This is just unbelievable. I CAN NOT believe that the kids were taken away and the parents had to go on registry, and mom lost her job for a year. For what? How many of us take naked pics of their kids bc we think they are so cute and adorable? (most parents will understand what I mean).
What a hell is wrong with people?! This is just such an invasion of privacy.

Do I feel bad for the family? Yes. Do I think they have a claim against Wal-mart? A resounding NO!

The Wal-mart employee did the right thing by reporting what he or she felt was inappropriate material. They are required to report this stuff -- and yes, I can completely understand how a reasonable employee would think to report naked pictures of children as old as 5, with their genitals exposed. Wal-mart didn't take the children away -- CPS as the investigating agency obviously felt there was something worth investigating with these photos. There HAS to be more to this story if CPS removed the children from the home for a month to investigate.

Wal-mart didn't take the kids away from their parents. The parents are suing Wal-mart because they are the only deep pockets in the picture. We WANT people to report these things and not be afraid of retribution. If CPS took this particular investigation too far, Wal-mart had nothing to do with that.

If I was the developer and I saw several photos of three girls laying naked together, I would've called the police too.

The parents should've exercised discretion. It's one thing to encourage being "free" and all that, but it's another to take photos of it. These weren't photos of a 9-month old in a bathtub. What did they plan on doing with those photos? Three CLOTHED girls hugging each other would be much cuter on the fridge.

I do think that everything after that point was blown way out of proportion. Why were their names on the sex offender registry if they weren't guilty? I'm not sure what protocol is, but wouldn't a CPS check and interview with the girls cleared it up instead of taking them away for a month?

I see nothing wrong with bathtime photos. But I would develop those pics at home.

I would not want a stranger(s) in possession of my children's naked pics. There are TOO many sickos out there!!!!!

I would have to see the pics. I am sure there are parents who, in my opinion, might take pics that I would find a bit crossing the line. So I won't judge the employee's actions at this point and say they overreacted or not.

When I emailed my family my 9 mth old DDs pics of bathtime, I cropped up the armpits. Gotta be careful these days.

This is ridiculous! I take bathtime pics of my DD and do not see anything pornographic about them at all. The poor parents must have gone through he**!

i think there is pobably more to these pictures than just bathtime, they stated they took other pictures of the girls naked outside the bath,
so there are pictures not being released perhaps the children were being innocent and showing sisterly love for each other or just posing for the camera, but cps felt these pictures were not appropriate and took action,
in the end they were cleared, i do feel bad about the sex offenders list, if they were cleared they should not have been put on the list,

but i think these parents were wrong a little, use discretion and common sense, you don't need to take naked pictures of a five year old, unfortunately in our society that is not okay,

So ABC just had a segment on this and showed the photos. The photos were completely innocent. You could not see any genitalia. They were children hugging surrounded by a towel. There was one photo of the dad hugging the girl and she had a towel around her. They looked completely innocent. I cannot believe that there was any question or problem about the photos.

ABC News was able to obtain access to four of the photos. There are still nine other photographs which were not released because the Demarees' lawyer said that the photos were intended for private home use and showing them to outside parties would violate the law for distribution of child pornography.



The article also states:

According to the police report, photos were of the children in provocative positions, with their genitals exposed.

This happened to me when I was 8 years old and living in CA. We had an Au Pair from Denmark and she took pics of me naked stepping out of the shower. My Mom and I pulled into the driveway one day and there were a bunch of policeman there and there was quite an interrogation. My babysitter was totally shocked at how being naked is such a big deal in America and this was 20 + years ago. But, I'm glad they are vigilant about it because of all the perverts out there.

idk maybe bc i am not a parent but i think 5yo is a bit old for the bathtime pictures. i do NOT think the parents had any intentions other than taking cute photographs BUT to me, 5 is too old for that and to trust some stranger to develop those pictures.



I would have to agree with this. My daughter is 3, and I don't think it's appropriate anymore at her age to be taking bath pictures of her. But that's me, I'm sure the pictures were harmless, but still, it's not a baby we're talking about, so the line becomes very fine. Quite honestly, as bad as I feel for these people, thank god Walmart did something because it's better to be safe than sorry.

what these parents are going through is disgusting. i'm not for lawsuits at all, but i hope they win BIG against everyone.

5 is still very young. she was with her little sisters, not naked with teenagers. they probably treat the 5 year old like the 1.5 year old at bath time.

i literally just took video of my son in the shower about half an hour ago. he's over one year and i see no problem with it. i'm not putting it on youtube, but it's still on tape.

i also have photos of him in the bath. again, i don't understand why it's a big deal that the kid is 5. if parents don't make a big deal out of nudity, why would kids?

If you want to blame someone, blame the FBI, not Wal-Mart. The FBI has requested that photo processing labs report things of this nature and CVS, Costco, Wal-Mart, just to name a few, all have policies to report photos that they deem to be possibly criminal which includes kiddie porn among other possible criminal actions. This isn't new, it's been around for some time. Can it go too far, yes, but as they point out in the article, even if it's innocent, there have been incidents were employees have held onto photos and they've ended up in the wrong hands. All they are trying to do is protect the children. Perhaps the parents should have thought about who might get their hands on those photos before they sent them to a public photo lab.

that is terrible the poor family!!!!
my DD will be 3 in december and I have to fight with her to keep her clothes on especially after the potty, she refuses to keep her clothes on when she has to go potty and then to put them back on her she goes bananas and takes them right off, so my dd runs around the house naked not everyday though but a lot.
and girls pose, put hands on hip, tilt head, they are girls, IDK this is so sad what this world has come too

I work with CPS on a daily basis in my line of work.

They do NOT pull kids from house without adequate just cause.

On more than one occasion they have NOT taken children who IMO probably should have been taken.

There may be more to this families story...

There may and I stress may be something more to the story - but the incident took place in Peoria, AZ, so I venture to say the views of the people involved (from the Wal-Mart employee down to the CPS investigator) are very very different than here in New York which had more to do with the children being out of parental custody for a month. In NY you canNOT get on the sex offender registry without a conviction. However, as this case illustrates, that is not so in other states.
