The Wal-mart employee did the right thing by reporting what he or she felt was inappropriate material. They are required to report this stuff -- and yes, I can completely understand how a reasonable employee would think to report naked pictures of children as old as 5, with their genitals exposed. Wal-mart didn't take the children away -- CPS as the investigating agency obviously felt there was something worth investigating with these photos. There HAS to be more to this story if CPS removed the children from the home for a month to investigate.
Wal-mart didn't take the kids away from their parents. The parents are suing Wal-mart because they are the only deep pockets in the picture. We WANT people to report these things and not be afraid of retribution. If CPS took this particular investigation too far, Wal-mart had nothing to do with that.
I agree with all of this.

I've been thinking more about this case.
I still say that I wouldn't be able to say if CPS was wrong in this instance without seeing the pics.
BUT- the more I think about it- the more I believe that the Wal-Mart employee absoltely did the right thing.
Think about it- what if the pictures weren't of their children, but of someone else's?
What if they were taken by a caretaker, or someone else who shouldn't be taking nude pics of your children?
How do you know those pics aren't going to be used for the wrong purposes?
I think- better safe than sorry.
Their names shouldn't have gone on that list and the children shouldn't have been taken away until something was proven to be wrong- but this has nothing to do with walmart.

I think its disgusting!!!! Taking kids away from their parents for a photo of 3 sisters hugging after a bath!!!!
I think not only should the family win the lawsuit, but the town should be responsible for monitoring these girls and whatever psychological damage inevitibly was done by yanking three children away from their parents for something that seems very loving.
I know I have tons of pics of my dd (3) naked in the bath- even with her cousin who is a year older. There is NOTHING sexual about that. And whoever thought the pictures were provocative- THEIR computer should be checked for child porn. I can't imagine how anyone could see what is described as provocative pictures.
ITA! Thank God Shutterfly didn't turn me in for the pic I had developed of my DD and two nieces in the tub together.

I am sure the photo techs or tech who saw these pics and turned them over has seen plenty of pictures that are cause for cringing, but I feel this person did the right thing and probably was just a tad creeped out by seeing naked pictures of children hugging, naked no less, with their genitals exposed.
I almost feel like in a couple of weeks it's going to be reported that these parents are hiding something, or there is more than meets the eye when it comes to this.
Naked baby pics, yeah, cute and OK.
5 year olds naked? Creepy and suspect if you ask me.

The judge ruled that the pics were in fact harmless so I feel for that family. However the walmart employee did the right thing. But it just goes to show how screwed up the system is--its taking so long to clear up this issue and get teh kids back to thier home which could cause actual damage. Once again GUILTY until proven innocent and the family will be judged as if they committed a crime.

If anyone has had trouble potty training a child, you would understand how easy it is for an older toddler/preschooler to be naked.
My DS didn't train until after 3.5. For about .75-1 year, he was bottomless at home, b/c we were hoping that it would click (and it did help with #1). now a year later (4.5) he has grown used to not wearing bottoms (and the top usually comes off too), especially after going to the bathroom and 95% of the time after a bath. His younger brother follows, and he wants his diaper off too (but that's not a good idea yet)
During the summer he would just put his vest on to go in the pool.
its so easy for kids that age to be naked. and don't forget the parents' are documenting their 1 year old too.
MIL lives not too far away from there - it's a pretty conservative area, plus there are tons of Mormons and Mennonites in AZ
