Sherri Shepherd does not want anything to do with her unborn surrogate baby ... because she believes her estranged husband defrauded her into having the kid in the first place so he could get child support ... this according to multiple sources connected with the couple.
TMZ broke the story ... Sherri and her husband Lamar Sally each separately filed legal docs to end their marriage. The big complication -- a baby will be born this month to a surrogate who signed a contract with Sherri and Lamar.
Now our sources say ... the baby was conceived with Lamar's sperm, but NOT Sherri's egg.
Now here's where it gets tricky. We're told Sherri does not want custody or even to be considered a parent ... because she doesn't want to get stuck with massive child support payments.
Sherri wants a judge to rule she has no parental rights or responsibilities -- which would shut the door to child support. She claims Lamar defrauded her -- that he got her to sign on for a surrogate birth knowing full well he would divorce her and then nail her to the wall for child support.
Our Lamar sources say Sherri tried to get pregnant in vitro and when it didn't work she got deeply involved in the surrogacy process.
Another twist ... Sherri has filed for divorce in New Jersey and Lamar has filed in California. This is not a coincidence. We did some digging, and found New Jersey courts generally do NOT recognize surrogacy agreements, which means Lamar would probably be shut down. Not so in Cali.

I really hope what she said was taken out of context. There is no way she was "pressured" into signing the surrogacy paperwork and I think it's pretty pathetic to disown your unborn child because of money and not to mention she doesn't even want custody.

Exactly this. I hope they put the baby up for adoption and goes to a family who actually want it. There are so many deserving people out there that would do anything for a baby.

that's real ugly, real fast.
someone needs to explain how you get pressured into signing surrogate paperwork... otherwise, i've lost all respect for her.
could this be why they asked her to leave the view?

I really hope that isn't true. I don't want to believe that humanity is really this awful. You would think shame alone would prevent her from doing this. If true, I'm embarrassed and ashamed for her.

They used a surrogate and she wanted a child. It was to be her child. Now that he doesn't want to be married, it's not her child? And if he truly led her on knowing he was going to do this, OMG. Every aspect of this is awful.
If true, such a slippery slope! This is how laws get changed and created, when mess ups like this happen.

My heart goes out to this sweet baby who hasn't even been born! Why can't she take the baby and HE pay her child support? Does he think he would be the custodial parents and get support from her? How can someone be so emotionally invested in having a child and then change their mind?

This is sad. I may be in the minority but if she doesn't want this baby why force her-give the baby the opportunity to go to a family that will truly want to be parents.

I'm guessing since the baby isn't biologically hers, only his, and if they were to divorce or legally separate before the baby was even born, he would end up with custody. Just a guess since I'm not an expert.

At first I was appalled....then I started thinking maybe it is better for the child to not have parents at each other's throats and having to go between CA and NY constantly...then I think how she must've have told her son he was going to be a brother, she must've been so excited when the surrogate confirmed a pregnancy...and how this new baby won't have a mother at all if she steps away. Then I feel she's wrong again. Tough situation. I don't know why they did this if their marriage wasn't going well...Unless it went south overnight? Who knows.
I wonder of the surrogate feels like she wants to keep the baby inside as long as she can, safe and protected from all this drama. I wonder if she would've went through with it if she knew they were going to be apart. Super sad situation.

I agree. It's not in anyway her baby. She would never get custody anyway because it's his baby. I can see her point of view. It's still his baby so I don't know why putting the baby up for adoption comes into play. I would think he would raise his baby. If not he was in it for the money.

It IS her baby. She signed documents and went through all the steps to secure a surrogate and watched this surrogate get pregnant with HER baby. Just because her egg was not used does not mean it is not her child. That's like saying I can just give my adopted daughter back because she didn't come from my egg. In my opinion she is more liable for that baby than someone having a one night stand. She knew what she was doing and it was not an "accident". She went through the process, filled out the paperwork, picked a surrogate, went through the beginning of pregnancy with her. What she is doing is deplorable and while I hope she does not get custody of this poor child, she is just as financially responsible for this child as the husband is.

Playing devil's advocate here - but if this coin were flipped and it was the MAN insisting the woman defrauded him and deliberately got pregnant knowing she'd divorce him (or just for the child support0 everyone would be up in arms all HOW could you say that blah blah blah -
Honeslty, when it comes to these self rightwous, selfish, self important 'celebrities' NOTHING shocks me - NOTHING at all - it's like they have their own moral code .....which is NO moral code.
I feel terrible for the surrogate, and for the child, who is some day going to read about this crap -

ITA. I don't know legally what the result will be, but IMO, that baby became hers the minute she signed the surrogacy papers.
If this is all true, they are both scum.
