WOW that is crazy!! I can't imagine anyone being forced to sign surrogacy papers. I always remember her talking about her desire to have more children but knowing she wouldn't be able to carry one herself. She wanted that baby and IMO it's hers. I guess legally should have had to adopt the baby once it was born? So I don't know what the court will decide. But that poor kid. It got ugly fast; and they're playing dirty.

Terrible cases make bad law. I feel for the child. But on some level I am sure Sheri feels swindled by her stb-ex.

It IS her baby. She signed documents and went through all the steps to secure a surrogate and watched this surrogate get pregnant with HER baby. Just because her egg was not used does not mean it is not her child. That's like saying I can just give my adopted daughter back because she didn't come from my egg. In my opinion she is more liable for that baby than someone having a one night stand. She knew what she was doing and it was not an "accident". She went through the process, filled out the paperwork, picked a surrogate, went through the beginning of pregnancy with her. What she is doing is deplorable and while I hope she does not get custody of this poor child, she is just as financially responsible for this child as the husband is.
ITA. I don't know legally what the result will be, but IMO, that baby became hers the minute she signed the surrogacy papers.
If this is all true, they are both scum.
This baby exists because of the two of them, they together decided to create a child (biologically or not). THEY created a baby. It's THEIR baby. This specific baby would not exist had she not found an egg doner and surrogate.
