That right there, as far as they were informed, provides the district with the legal authority to ensure that the teacher is complying with state laws.

I'm curious, are you suggesting that teachers should NOT be held to the same standard that most other fields are held to? Do you not think that teachers should be drug-free?

It does not say consequences, but no where was I talking about consequences. I do think that teachers that smoke SHOULD be faulted. I'm sorry, but I don't want my child to be in a classroom that reeks of cigarette smoke where they could be exposed to third hand smoke, or think that smoking is OK because the teacher they look up to smokes. And MOST teachers are well aware that this is a no-no. As for obesity, yes, I think that a teacher who is morbidly obese is presenting a poor example for children, but if you are standing all day teaching, chances are, you aren't morbidly obese.



I agree with you about teachers needing to provide a clean environment and the importance of teachers setting a good example. (You would be surprised at the size of some teachers I have had, so I guess standing all day didn't help.)
I know you were not talking about consequences so that is why I am asking. I was wondering what can happen to a teacher in this district, if in the eyes of whoever is in charge, they do not comply with this code of ethics? A warning, suspension , firing? Depends on the offense?



I actually did not read down enough (and as much as I'm loving this debate, I don't have time here at work)... but I would imagine it would follow the verbal warning, written warning, suspension, etc ... Depending on the offense. And I would imagine, there would be a difference if it was heroin found versus pot.

Also, I'd like to add that the contract does not explicitly say that a teacher cannot be intoxicated during school hours, however if a teacher was found to be DRUNK during the school day and in the classroom, you can bet your bottom dollar that there would be consequences.

In my district any employee, teacher, secretary or custodian can be asked to submit a drug test if their is suspicion.. Also if found to be on drugs or be an alcoholic, you do not get fired, if you say u have a problem they require you to get help and if they do still can keep their job.

Me too. If it was a middle school or high school the net could be cast more widely- it was not unusual for students to use the faculty bathroom in my old school- the door stuck and very few people could be bothered to pull it closed tightly.

Absolutely... I know it's different now, but when I was in elementary school, I really don't think it would have been difficult for someone to have just walked in through a side entrance door from off the street and used the bathroom.

If I worked at a place and this situation arrived, I would be the first one in line to take a drug test to prove I am clean. I haven't attacked teachers with this thread, I just don't understand why they are being told to not take a drug test. You only look guilty if you don't take it.

There is so many people who don't understand mental illness and would be afraid.

All they would need to do is to target what they are looking for. They can just do a drug test for heroin or cocaine. It does not have to include every single drug out there. But in my opinion it should include all illegal drugs, and if you have a prescription for something then it shouldn't be an issue.

I was wondering if there was a single test for heroin. Not sure why they would need to test for anything else. Just heroin.

No!!! HIPAA laws make it very clear that the insurance provider (say united healthcare) cannot tell the employer any of the information unless directly consented to by the patient. So, while the insurance knows, the employer does not.

I was just trying to read articles and find out more about the case, one thing I came across in comments on another article is that heroin only lasts in your urine for a couple of days . (Looked on other sites to try to verify and they seem to say the same thing, you know, since everything on the internet is true). The police officer is specifically quoted as saying he wants a urine test. Unless a person has used the drug since the 11th ( when the needles were found) it would not show up in the urine. If a person is an addict they have used since the 11th but still, a urine test as this point technically does not tell about the 11th.

Not saying I agree with this, I am just trying to figure out the UNion's point of view and reasoning for advising the teachers not to take the test. I would be mad if I were made to feel bad about taking the test myself if I were in that situation.

That Fox News article is so misleading and something I've noticed many times with them when there is a situation involving unions. Other news sources reported that the Union told the teachers to get their own attorneys and the attorneys advised the teachers not to take the drug tests.

As a matter of course, I think most attorneys would initially advise their clients not to willingly submit to the test without a warrant. I am not sure that the fact that they used a somewhat public restroom (earlier that day?) would suffice as probable cause to issue a warrants for all of them but it's been many years since I studied constitutional law.

Having said that, the drug abuse epidemic in this country horrifies me. To think that a small child could have stumbled upon these things while at school is terrible!

I didn't know that I am supposed to take liberal biased news sources as fact and dismiss conservative news sources. You people teach me so much.

There was no mention of liberal versus conservative, it was a very specific news outlet that was mentioned as being skewed.
