whats the law on having to take a cab? Is this not allowed because there would be no car seat?

There is no law about car seats in cabs- so you can take your child in without one.
But personally- I would NEVER.
I fear for my own life every time I am in a NYC cab....no way in HELLLLL would I be taking my daughter in one- ESPECIALLY without a car seat.
The thought alone makes me feel ill.

Yeah, you def. don't need a car seat. Not sure how comfortable I'd feel, but people do it everyday.

But this is what I never understood- maybe someone can enlighten me..

If I told you that my DH needed to run to the store- let's say a mile or so away- here on Long Island- and was home without a carseat so he just put my DD in the back seat of his car, unrestrained and drove to the store and back- what would you say? Let's put the fact that it's illegal aside for a second.
Wouldn't that be outrageous?
Wouldn't that be bordering on call CPS?

So how is it ok- in NYC- where people, especially cabbies, drive like utter maniacs and the traffic is insane and the driving conditions are 100 times worse than anything I have ever seen on Long Island- to take your child unrestrained in a cab?
I just never understood that, but maybe I am missing something.

It is not the same. You are holding your child, and the car is going relatively slow in city traffic typically. Not saying a car seat isn't safer, but I don't think it is the same as putting them in the back seat alone and unrestrained.

Im pretty sure the original poster didnt post this looking to get torn apart. The answer to your question is Yes, You can ride legally in a cab without a car seat if you chose to do so. Enjoy your day.

Ok, so say we are all driving on the LIE in traffic, DD starts fussing so I get in the back seat and take her out of her car seat and hold her on my lap?

the answer is - that yes they can legally sit on your lap in the back seat of a cab
it is up to you if you are comfortable with that or not

here is the FAQ from the nyc taxi & limo commission

• What are the rules regarding child safety seats and seatbelts in taxicabs?

Drivers of yellow medallion taxicabs and for-hire vehicles and their passengers, are exempt from laws regarding car seats and seatbelts. Keep in mind, the TLC encourages everyone in the vehicle to buckle their seatbelts while riding in a cab. There are no Taxi and Limousine Commission rules regarding this, as it is a State exemption. Passengers with children are encouraged to bring their own car seats, which the drivers must allow passengers to install.
*NOTE - Children under the age of seven are permitted to sit on an adult's lap.

We used to take cabs all the time when we lived in Manhattan without a car seat.

However, I have heard of moms who had to go out and buy a car seat because the hospital would not let them leave the hospital without a car seat.

Yes you can take your DC in a cab. Emergencies come up and things happen. Not everyone has cars, and sometimes you need to take DC in a cab or ride on a bus all day with out a carseat.

My sister had to pick up my niece in a cab from school a few years ago. She didnt have access to a car and had to commute from NYC to pick up my niece in NJ. From there she took a 5 min cab ride to her house. It is legal.

As much as I agree that these taxi drivers sometimes drive carelessly, I think the situation is different if someone was in a jam and needed to take a cab and have their child on their lap strapped in as opposed to the example youre comparing it to with having a child alone unrestrained in the back seat of a car.

Is it legal? Yes.
Is it safe? Probably Not.

If you are leaving from a hospital, they do make sure you have a carseat.

However, it is crazy to assume all NYers are walking miles and blocks with a car seat in their hands. It's impossible.

And people who commute and take the bus... it's the same as a cab. Buses don't even have seatbelts. Not for the adults or for a car seat to be buckled into. A bus isn't any safer than a cab. So for the people complaining, yes it's dangerous but this is how lots of people have to live. And it is legal.

Oh I am with you 100% on this! I don't see how it's legal (or SAFE!!!) at all! I'd feel much much safer with DD in my car's back seat in a seat belt (or on a lap or whatever you want to say) driving around LI than in a NYC cab.

It's a proven fact that you can't maintain your grip on a child/baby in a bad accident because to force is so strong. I really don't understand why this is allowed. I imagine eventually it will be illegal, as I do think it should be.

I've always wondered the same thing

If i absolutely had to take a cab, i guess i would hold onto my DS with my dear life. I can't imagine it being safe at all though, especially with that damn plexi partition and the fact that you slip/slide around those seats all the time in cabs anyway.
I'm glad that every time ive been with DS in the city (which has only been twice anyway), we've had our car! I would take a subway with a stroller over taking a cab unless there was no other option.

I don't know how other parents that live in the city do it..

it seems to me that its legal only because they can't figure out any way to do it. They can't require car seats because then every cab ride would become infinitely longer as the person tried to figure out how to install it and remove it, plus there's no seatbelts on buses etc.

Of course not - that is illegal. And I said having them in a car seat is safest of course. All I was saying is that being in a cab going 20 mph and holding you kid is not the same as getting on the LIE going 65 mph and leaving them alone in the back seat.

And if you are stuck in traffic on the LIE and going 10 mph and you get into an accident it is highly unlikely anyone would be hurt. It is illegal to take your kids out of the car seat in a private vehicle, so I wouldn't do it, but I also think the potential for injury is pretty low in a situation like that.

Legal or not...it seems like a risk I wouldn't want to take.

A bus is safer than a cab based solely on its size. As its likely going to be larger than whatever it hits, the forces will be less as the deceleration will be slower than in two equally sized cars. The bus "wins" so you are safer. Also buses are more visible and therefore less likely to be in an accident.
