What is the law on cell phone use while you operate a vehicle in NYS?
New York State has passed a law that does not allow you to use a hand-held mobile telephone while you drive. If you use a hand-held mobile telephone while you drive, except to call 911 or to contact medical, fire or police personnel about an emergency, you can receive a traffic ticket and pay a maximum fine of $100 and mandatory surcharges of $50.
This violation is not a probationary license violation, and the DMV does not assign any driver violation points

No points. It depends on where you get it. DH got one in Queens I think and it was $85. I got two in Nassau and it was $150.

I thought it was a moving violation and therefore there were points involved. I could be wrong, I've never gotten on *knock on wood*.

nope we have 3 or maybe even 4 in total and no points (knock wood)

Not true. We are considered high risk and were dropped from an insurance company because of it. And that was just with the first 1 or 2.

The first one with me was right when the law came out. The next was when DH was sent to the ER and I was soo frazzled.
DH has no excuses other then he can't find a hands free that he likes

its not a moving violation, therefore it cant be looked at,....just like a seat belt.
Maybe you should look into other ins company who dont charge for that.

Well they dropped us so we had to find another company It doesn't matter anyway because we found better rates with another company anyway.

it absolutely positively is considered a moving violation in nyc. first offense or just pleading guilty and mailing it in is $90. if you try to fight it and lose, and it isn't your first offense, the price goes up.
