The cure IS worse!

Thoughts

I recently learned that my OBGYN has sold my name and my due date to some baby companies.
Do you think this violates my right to privacy? AND do you think it violates the Dr/patient confidentiality clause.
The dr's office states: "We didn't give them any information about your health, just your due date"
My feeling is that by giving out my due date you are commenting on my health.
Thoughts??

I don't approve of any company giving out any information on clients without written consent, especially in the medical field.

Your doctor's office is WRONG. I'd be p!$$ed!

They actually SOLD it for money?
So they want the money versus caring if the patients information gets in the wrong hands?

I wonder if this is standard practice? I guess you cant know, but that bothers me.

Thats a good question Donna, I assumed that they sold it but I don't know that for a fact...they might have just given it away.
I am not sure which is worse

I think they should have asked you, what if you didn't want your name out there. What is someone you knew worked for one of the companies and you didn't want them to know. I think they were in the wrong.

I think it violates your right to privacy with regard to any and all medical situations.

If there are companies that would offer you free samples, rebates, etc they can always give you the names of the companies to contact but they should not take it upon themselves to divulge your name & due date for you.

Ah...I always wondered how come I almost immediately started receiving pregnancy and baby stuff in the mail when I hadn't even told anyone (or signed up online anywhere) that I was PG. I wouldn't be surprised if this is a common practice. But yes, I do consider it a violation of your privacy rights. Telling them your due date is essentially telling them you are pregnant and that is private information, IMO. Nobody that you don't personally tell needs to know that.

Did they give you a privacy statement on HIPPA and their policies - and did you sign it? I would ask to see a copy of it. You may have signed off on allowing him to sell your information.

Deb - I would repost this on the pregnancy board to make the other moms to be aware of it before they sign their HIPPA statements.

By Law, they cannot release any information about patients without their written consent.
They said they only gave them your due date....I bet they also gave them your name and address too.
Regardless, they should consult their patients before giving any patient's information to any other third party.
Under HIPPA....your rights should be protected and not even your name should be disclosed to anyone.......or any information about you without your consent....
I'd be pretty upset if they did this without my consent.....

I would be pretty ******. IMO its no ones business that you are pregnant unless you choose to tell that person! Or sign up for things online. Have you said something to the dr?

How did you find out they were giving out your info? Do you have proof it was them?

i'd see who I could file a complaint with.

The hospital does the same thing, at least up here in NY they do. I went in at about week 36 due to false labor, and the day after I came back home I got a phone call from a baby photographer asking did I want to schedule a shoot since I came home with the baby the day before. They called again after I actually had the baby. There's no way they would have known unless the hosptial provided that info.

Yup, my friend starting getting all these free samples and solicitations at home, after the baby was born too.

You are so right - When I worked for an insurance company, agents would buy the infamous Nassau/Suffolk Baby list. They also do it with new mortgages.

I'm glad to know that so many people had the same reaction I did.
On one hand I don't really care...the nurse said I am going to get $250 worth of coupons!
on the other hand, I like to fight things purely oon principal.
