I'm surprised they did this from a liability standpoint. The mom was visibly pregnant. What if spending the night in jail AFTER they offered to pay for the sandwich caused her to miscarry?

She broke the law. If you have a medical issue while in jail you can still get treatment.

I don't see any liability issues here.

You're wrong about that one pal, it's the stress that could cause you to miscarry!

The store was wrong, I'm sure the manager will be fired, and rightfully so...

Stress has been known to be a CONTRIBUTING factor to miscarriage but it's a huge leap to say a store that is arresting a person for theft caused a miscarriage.

As I said I'm sure there is more to the story than what's being reported. But what no one is disputing is she walked out without paying for food.

Exactly. Stress can lead to a heart attack, so I guess that means that no one ever should be arrested.

WOW tough crowd! Unbelievable

I know right. Chat Icon Safeway dropped the charges. http://www.aol.com/2011/11/02/hungry-family-steals-sandwich_n_1071272.html

Grocery shopping is a chore that now bring some anxiety, Nicole said, adding that she has read countless comments online criticizing her for eating before paying.

"I didn't know it was such a taboo thing," she said. "Where I grew up in a small town it's not seen as stealing for sure."

The Leszczynskis had hired a criminal defense lawyer to fight the charges but are unsure about whether to pursue legal action against Safeway.

"I haven't even considered it because I was just so worried about the charges," Nicole said. "I do feel like something went terribly wrong and we were abused in some way.

I would hope that the manager doesn't get fired.  In the eyes of the law she stole from the store.  I'm sure he hears excuses after excuses when a shoplifter is caught.  Where do they draw the line?  Do they let everyone go if it's under $5?  (I would hope not).  I would hate to see him get fired because someone stole from a store he is responsible for.  I'm sure there is more to the story, but right now we are only hearing her side.  Just because she said she forgot to pay for it doesn't mean its the truth.  I would hate to see someone get fired for her breaking the law or forgetfulness.

If I were that woman and I was arrested and my CHILD taken fromem and traumatized, I would not stop till he was fired and I would cause a whole lot of grief for people. They offered to pay. There is NO REASON why the manager shouldnt have said, yes, please pay, and thanks. And let it go. Isisnt that what it is about? the MONEY? She wanted to pay!!!

Lindsay Lohan stole a $2500 necklace and was treated better than this young family who "stole" a $2.50 sandwich. Chat Icon

it's just the twisted disgusting world we live in! ugh!!

this was way out of line and the punishment certainly did NOT fit the crime AT ALL!!

i think the grocery store owes a major apology in this case. 2 wrongs don't make a right. I get that technically she 'stole' the sandwich...but really to treat them like that is overboard.
sounds to me like a couple of d bags working that night had a chip on their shoulder. yea i'm being blunt... Chat Icon

they weren't on a diamond heist... they ate 2 sandwiches TOTALING $5.... and offered to pay for them. The amount of merchandise stolen does make a difference to me. I don't think $5 is worth a night in jail and to have your kid taken from you. Just pull them in, and ban them from the store... no need to arrest them..that's a total waste of time and money. You know the judge is going to throw that case out. It's a waste of taxpayer money if you ask me. Better spend elsewhere...

Re: Pregnant mom arrested for a sandwich

I think it's equally heartless to call for the manager to be fired. He was absolutely overreacting and could have/should have handled it better.. but how is getting him fired going to make the situation better? His family should suffer because he made a stupid judgement call? That's pretty heartless..

I agree. Perhaps the manager was following protocol and doing what management was told to do in these cases.

Why should the manager be fired for handling a theft case in a manner which may not have been ideal but the people that stole - whether by accident or on purpose - be completely without fault. Had they paid for their groceries prior to eating them, the situation would have been avoided completely.

A decision that was made probably after they realized they will be losing quite a few customers.
