It really depends on you company... I actually just called HR to confirm mine:
Total/MAXIMUM of 12 weeks it is all considered to count towards FMLA:
-week 1 - use sick/personal time -then 5-7 weeks of 100% pay short term disability -remaining 6-8 weeks up the max 12 will be unpaid unless we choose to use vacation as part of that time in order to get paid.
That's how ours is as well - except we get 5 weeks of 75% pay for std regardless of what type of birth. Since certain taxes aren't taken out if std, the pay is higher for those 5 weeks.
I am required to apply for NYS as well. The company deducted the amount the state pays from the amount their disability provider pays - so I don't get it on top of my company's private disability, it goes towards the total amount the company owes me.
People can take off more than 12 weeks at our place with manager approval.
