Kris Humphries may be forced to undertake an STD test to prove he doesn't have herpes in relation to his ongoing lawsuit brought about by one-night stand Kayla Goldberg.
The plaintiff is suing the basketball star, who was briefly married to Kim Kardashian in 2011, for allegedly giving her the sexually transmitted disease when they slept together on August 31, 2010 - just prior to meeting the reality TV star that October.

While the 29-year-old has always vehemently denied that he has the herpes virus, it's since come to light that he never actually submitted to testing, and Goldberg's lawyers are requesting that the judge order him to do so in documents obtained by RadarOnline.

The documents read: 'Since the outset of litigation, Humphries has steadfastly denied having any herpes virus. Humphries has also admitted that he has never been tested for herpes simplex virus type 1 ... At the same time, Humphries has refused to submit to a test for sexually transmitted infections to lay this matter to rest.'

The attorney cites 'good cause for a physical examination' and Kayla has scheduled an appointment for Kris to have the relevant tests at 10am on June 16 at Abbott Northwestern Hospital in his hometown of Minneapolis, Minnesota.

The legal documents, dated April 28, ask that the judge presiding over the case enforce his attendance.
Kayla's legal team is arguing that a screening for sexually transmitted infections is necessary as the defendant 'denies that he is infected with any herpes virus, yet has simultaneously admitted to not having been tested for herpes simplex virus type 1. In essence, Humphries wants Plaintiff and this Court to take him at his word that he is free of any herpes virus while refusing to submit to tests that prove that is so.'

The athlete has previously refused to submit to her request or to answer questions as he says they are 'an invasion of privacy, violating work-product and ... [seeking] information that protects communications between a patent and his medical provider'.

On January 29 last year, however, a source told Radar that Kris has submitted to testing, which ruled out the presence of all STDs.

The insider told the website: 'Kris knew there was no way he gave Kayla herpes, so he took a blood test to prove it. The results, filed as part of Kris' response to the lawsuit Kayla filed against him are under seal, but he was found negative for herpes, AIDS, or any other sexually transmitted disease.
'Now, he just wants to clear his name and get on with his life – sexually disease-free.'

Goldberg claims in her lawsuit that she was 'free of any venereal diseases at the time she commenced her intimate relationship with Kris Humphries'.

However, she 'developed symptoms of herpes about or around four to five days after the first sexual encounter with Humphries. These symptoms included sore throat, fever, body aches and immobilising pain, extreme pain, extreme vaginal irritation and painful lesions on her genitalia. A doctor officially diagnosed Goldberg with Herpes on September 8, 2010, through an examination and swab test.'

What will this prove? Its 4 years later, so even if he tests positive either he could have gotten it from her, or he could have gotten it from someone else since their encounter.

So even if he tests positive- who's to say that SHE didn't give it to him?
You can have herpes and not know it and not show symptoms. So she could have had it from some other random she slept with, and passed it to him before she even had an outbreak.
Ridiculous.

And since when do you sue someone for giving you and STD? What does she want? Money to pay for her Valtrex?

How about protecting yourself before hand?
