Just an FYI..

I figured my DH probably isn't the only person who takes conference calls in the car, or any call for that matter. But he just received a ticket for $140 Bc he was using his headset with both ear buds in, you are only allowed to have 1 in while driving. Just figured I'd throw it out there so nobody receives the same ticket!

Re: Just an FYI..

Yeah apparently you are supposed to only have one in so that you have an ear open to hear for emergency vehicles and sirens. Random. I didn't know that either until I started working on sobriety checkpoints and it happened to come up in convo as people were filing through the checkpoint.

Here's a question - what if a driver is deaf? Doesn't that create the same "not able to hear" situation as a person with two ear buds in? Interesting!

I had never seen the ticket actually written when I worked in a police department for years lol, but my DH said it was some detail they were doing this week.

I imagine disabled people either get a pass, or Bc they have to register that they are disabled with their license that they may need some type of alert systems for emergencies. But I think the ticket is a bunch of bull Bc he was on a phone call, not blasting music like some people do. He was still able to hear all around him, he just had both in Bc the call was overseas and breaking up a bunch.

IMO they should have just given him a warning.

Re: Just an FYI..

I just asked my boyfriend and he said they have been trying to do little like, "stops" here and there to let the public know about this because so many people aren't aware of this law but now it is so common for people to be driving with hands-free earbuds in so they want people to know that it's fine, just don't have both. BUT he did say, that in making the public aware every single officer he knows are mostly issuing warnings and kind of doing an "FYI" type of thing when they stop people or notice it --- not actually writing them!

He's like, that guy's name wasn't Jimmy, was it?? LOL! (inside joke about a cop we know) and I said, I'm not sure but I will ask Chat Icon Chat Icon

Exactly! I would totally understand a warning, and I'm still surprised about it, I kept grilling my DH like "you didn't give him attitude right" lol.

It actually does say James, which I think Jimmy is a nickname for? Lol but this was in NJ, so apparently that name likes giving out this ticket lol

I agree...seems like common sense to me.

And silly IMO to compare this to a deaf person.

Luckily this isn't points, but hopefully your boss is able to win since he has proof he wasn't actually using his phone!

Are you joking?!

I wasn't COMPARING it -- I was legit asking a question.

I know tons of people with disabilities who drive and I was seriously curious as to how one who is deaf would be able to account for emergency sirens. In all seriousness, not trying to compare it or "excuse" the one behavior by asking about that particular scenario at all!!

Just an FYI..

If you have a disability you have to use modifications to the car in order to drive. Specifically deaf people need a special "all view mirror" installed and there are also devices that can be install to alert them if emergency vehicles are coming.

I may be naive, but how did the police officer even know he had both earbuds in? Did he just get stopped for no reason or did he not take them out when the cop came to the car?

I had no clue this was a law!

My brother drives around with his music blasting. I've been in the car with him and there is no way he would hear an emergency vehicle and thats not using headphones. How can earbuds/headphones be illegal but it's not illegal to listen to blasting music? Such a random law Chat Icon

I am sure you can get a ticket for blasting music too. Both are hazards to yourself and others on the road.
All common sense, again.

They were doing stops on all cars, the cop saw him when he was a couple cars back while he was still on his call. He took them out and hung up the call before the cop got to him, but it was already too late.

Exactly, if they were noise canceling I would completely agree with the rule, but he was obviously able to hear everything going on around him with both buds in. He was so caught off guard that he didn't even use his fop cards to help, oh well, hopefully nobody else, on lif at least, gets the ticket!

Listening to music/phone call with 2 earbuds typically closes you off to other things going on around you.

As a deaf person, you're actually heightened visually to what's going on around you, plus as pp said they have special mirrors plus special detectors that can light up when it heats the pitch of a siren.

Yes. And me posting about the deaf person situation was just to learn more about it and open the discussion -- not comparing one to anything else and not excusing the action of breaking the law by having both buds in.

So, you could have just posted the insight you just posted above the first time around.

It would have been a lot more helpful.

I volunteer with people with disabilities. I have the utmost respect and admiration for those who live each day facing any kind of adversity like that.

Re: Just an FYI..

I think some people are reading a little too much into this. Clearly you can't compare a disabled person to someone breaking the law, that's just silly, and I'm surprised anyone thought myself or Danijude was implying that. I wasn't trying to debate about whether DH deserved the ticket or not, Bc he did in fact have both buds in and it's against the law. I think it would have been nice to get a warning Bc it's not a law typically enforced and therefore not a "common sense" law as previously stated. But I merely wrote this post so someone else who didn't know about this particular law wouldn't do it and end up with a ticket, and that was done, so end of story, no need for petty drama.
