Do you think I have any recourse?

There is a church directly behind my house which over the summer they demolished and rebuilt. The church used to be on the corner, now is literally short distance from my fence. Over the summer between the demolition, construction trucks and building my house shook almost daily. My neighbors also complained about the noise and shaking from the trucks. Some of my neighbors had china in their cabinets break.

I have noticed some damage in the addition to our house (which was added before we purchased the house). My back french doors are off level now and barely close, we have a crack in our ceiling, there is a space between our kitchen cabinet and ceiling in one area and had a pipe burst under the addition.

My father thinks I should call the town and complain. I can do that but I explained to him that there is no way to prove this "damage" wasn't there before the church was being built. I am going to ask my neighbors if they experienced any structural damage but I still don't think the church would ever take responsibility.

I would talk to the neighbors before deciding if you have any recourse...if they experienced similar issues, I'm no lawyer but i'd say you guys certainly have a case...

do you have any pictures of the space before the crack - maybe with your kids in it - where you could proove a date based on their age?

Re: Do you think I have any recourse?

I hate to say it but unless you can prove that the damage wasn't there before then you probably can't do anything. You can try to contact the church and see what they say. As far as if they say no we won't so anything you would then have to sue them and that's where you would definitely need to have proof.

I actually deal with this stuff all the time and unless there is proof usually doesnt work out.

Re: Do you think I have any recourse?

My mother's house is on a block that's been undergoing construction for the past 2 years. She had similar types of damage on and off; but she was able to talk to the building company owner (he's been on site almost every day, and while other neighbors called "311" all the time about their noise and dust etc etc my mom just left 'em alone to FINISH).
When she told him about some of the damage, he sent his guys in to fix EVERYTHING, didn't even question it. I guess he appreciated the fact that she wasn't getting stop work orders on his crew every other day.
Can you talk to the builders, or have they finished the project now???
