Passport renewal - name issue
I need to renew my passport - it expires this November. I had the passport before I got married. I legally changed my name after I got married, but never changed my passport - so it is still in my maiden name. I am now getting divorced, but the divorce will not be finalized before I need to renew. Can I renew the passport as it is - still in my maiden name? The instructions for renewal by mail state that the expiring passport must be “in your current name.” I really don’t want to get a new passport in my married name at this point.

I kept mine in my maiden but I never changed my SSN. I don't think you'd really run into any issues, especially since you still have your old one, right?

I believe you can still get it with your maiden name. Can't you also legally change your name before the divorce is finalized?

Nooooo you need your judgement of divorce. I walked around for FIVE years with a name I wanted gone
Sorry OP for the hijack. I think you can renew in the same name without much issue

are you flying? I had a problem when I didn't think to update my passport that had my maiden name but my flights and vacation was booked with my married name. I had to change it with 3 weeks before the trip

Any time I've traveled where I needed my passport, I made sure to book everything in the name on my passport, so it's never been an issue

I believe if you have a valid passport, you don't need any other documents to renew it, so you should be ok.
are you legally using your married name elsewhere ( SS, driver licence?)

You may have to renew it with your married name and then get another in your married name unless you want to wait. If you're not traveling anywhere anytime soon I'd wait until my decree came in. If you are traveling then remember everything must match--your ticket and passport name.
I know how you feel. I couldn't wait until I had my decree in my hands. I went to the courthouse myself to get it because it was taking forever to get from my lawyer. The same day I went to dmv, social security and changed my name. Passport agency also the following week. I couldn't wait to be "me" again. Good luck!

But I don't want to change the name on my passport. I want to leave it the way it is - which is currently not my legal name. That's what I'm wondering about

If you are using your passport to travel BEFORE changing your name back - you need to change it.. Your passport has to be in your legal name during time of travel

This is going to sound very dishonest, but I just wouldn’t give anything with your married name on it. I haven’t done a passport in the US in ages (I get them renewed overseas), but I remember I only had to give my birth certificate the first time.
I went to renew a few months ago and I only needed to show my old passport and fill out a form. I think there might have been a part that asks about married names, but I forget. Look up the renewal forms and take a close look at it. This is what I would do in your situation. As long as your passport name matches your plane ticket, then that’s all that counts overseas.

I had a quick look at one form and they wanted to know about a name change. But I didn’t look too closely at it. You may just have to renew in your married name and then change it back to your maiden. PITA.

To the OP, are you traveling anytime soon? That's really the question. You can let your passport lapse until your name is changed legally. What you cannot do is renew your passport in a name that is not legally yours, even if it is your maiden name.
If you have to renew it sooner, you can then get a new passport within a year once you change your name back. It's just more paperwork.

But why?
Although I legally changed my name everywhere else, I never changed my passport over after I got married and anytime I traveled internationally I just booked flights in my maiden name. Never had an issue in the over 8 years I traveled that way, even though it wasn't "legally" my name anymore.
To the OP, I would try to renew using the maiden name. The worst that could happen is say no.

OP when are you traveling?
There is a six month rule that you will get problems if it expires within those 6 months.
ETA: I’m having a similar problem with renewing my visa. They said I can carry my old passport with my visa and it should be fine. Ask about this. I had a new passport in 5 days.
