stopping work question

If you plan on stopping work before your due date. how foes that affect your FMLA, or any maternity benefits you get for time off?

My HR told me anytime off before I have the baby will cut into my 12 leave I'm allowed. so I plan on working until the day I pop!(hopefully). All I get is 12 weeks, I can't extend it any longer even with vacation/personal time.

I joked that I'm due on a Saturday, if baby doesn't come that weekend I'll be back at work on Monday!

I may have to go back to HR to clarify , but is it possible to fill out the leave paperwork with an open date for last day of work?

UPDATE: I just heard back from HR. I can put my anticipated stop date as my due date (or the day before) and if I continue to work beyond that date up until when I deliver; they'll just change the form accordingly.

Normally you fill out the paperwork with your due date as your expected first day out. You can just call/email or have DH do it when the baby is actually born. They will then adjust your time away from work, expected return date, etc. accordingly.

I really have never seen anyone work past their due date - at the latest, usually the leave starts on the due date.

Unless ou can take vacation days..yes it will cut into the 12 weeks mat leave.... So when people annoy me and say "why r ur still working" I want to punch them. Ummm because I'd rather have the time with my baby.

lol! I know, I'm trying to work until the very end!! Fingers crossed LO comes some time between 39-40 weeks so I don't end up at home 40+ weeks just waiting!

ok thanks! Ideally I want to avoid anytime home waiting between my last day of work and when LO arrives. It won't be so bad if I'm working from home those last few days.

if your dr has you go out before your leave starts you might be able to claim it as short term disability. i was on hospital bedrest prior to delivery and it would have been counted as STD except that i delivered before the end of the one week waiting period that my STD required so i never ended up being able to claim it. my maternity leave, which was also covered mostly by STD started the day i delivered.

I've always worked until delivery day because any time I would take before came out of the 12 week leave. I would rather have those 12 weeks with baby after they were born.

My boss will usually allow you to come in and work any days that are short staffed after your due date if you haven't delivered by then. She normally puts the day before you due date as your last day unless you request sooner (only one girl I know did this). I don't work your typical office job and we're always short staffed so this might not be possible for everyone.

Can you ask your boss if he/she would let you still come to work after you due date if you haven't delivered and feel up to it? I was put on bedrest at 34 weeks due to preterm labor and actually went back to work at 38 weeks when I was 'full term' so I didn't waste anymore of my maternity leave sitting at home.

Thanks! That's what I really plan on doing. I'm just confused because the leave of absense form HR gave me says it needs to be returned 30 days before my leave starts. I have to put a last day of work on the form. I'll have to contact HR to make sure if I put my Due date; can i modify it if I continue to work beyond that date.

OR could I just put a last day worked a week after my due date? I'm thinking they have to let me change the date; since people deliver before their due dates which will then change the last date worked anyway.

glad your HR was helpful. I sat down with one person in my HR and left more confused then when our meeting started! Then i met with someone else and she actually informed me that even though FMLA covers 12 weeks, if your doctor wants to give you an extension they can fill out the paperwork and you can submit it to your job and typically they are granted. My job said only once had she seen someone not get the FMLA extension...so maybe ask your HR about that next time you meet with them.

I did mention what if i'm put on out STD before the baby comes; and she said that would still cut into my FMLA. That I can only get 12 weeks FMLA through my company with my job guaranteed.
