UPDATE!!Question RE: Walk Through and Closing
If the sellers needed to stay for a few days after the closing for whatever reason, would we be made aware of this BEFORE the closing? We have the final walkthrough tomorrow and closing on Monday. I am so nervous that I am going to walk into the house and see all their furniture neatly in place! DH thinks I am crazy.
UPDATE: My intuition was right. She is not moving out until next weekend. Our REA and her REA had no clue. She apparently told her lawyer who didn't bother to call our lawyer. We have to reschedule the walk through and adjust our moving time. I am so angry right now. I felt like I was going to throw up when I wawalked into the house because I knew she wasn't ready to go. How can they do this??

Usually. Contact your lawyer.
Our seller was still in her house post-closing. Then we had to do a SECOND walk-through. She was also charged "rent" and had to pay for the daily charge of electricity, etc.

You should know. Ours did and we knew wayyy in advance. They would have to let you know so you make other accomdations to live b/c the house is YOURS at that point, kwim?

It was in our contract that we had 5 days after closing to move out and owners of the house we are buying have 3 days post-closing to move out.
I would think it would have had to be in the contract if she was staying after closing.

You would know in advance. How could you not? What if you planned to move in that very day? Also, usually your attorney and/or realtor will give you instructions about turning on utilities, because the seller will usually close their accounts as of the day of the closing, or sometimes the day before.
If the seller plans to remain, then it would have been negotiated.
It's not in the contract (because the closing date is always "on or about" and not scheduled and set when the contracts are signed), but there should be a provision in the contract that says that if the seller continues to occupy the home post-closing, then they pay X amount per day and a certain amount of money is held in escrow.
If you are very concerned - why not just relieve your anxiety and ask your realtor to find out when the sellers are moving (he or she can talk to the other realtor) and/or talk to your attorney to confirm you are taking possession at the closing. No sense in worrying needlessly -- your realtor and attorney are there to help you through the deal, so use them!

Thanks everyone! I am just having nightmares because this process has been so long. The homeowner wanted out of the house weeks ago so I am sure she is gone, we will find out today at the wakthrough. We aren't offically moving in until next Sat anyway...I am so done with this buying a house process!!!!

We knew in advance we had to stay over a few days after closing. We actually paid the new owners for the few days we where there.

It didn't bother me, I realized it was her right and I was ok. But sure, if I were you, I would be livid at surprises. But just try your best to remind yourself it will be over soon.

Thanks, I am much more calm now. It really isn't the woman's fault, she defintely has the right to stay there. I am just very annoyed that nobody knew about it! Her lawyer should have contacted my lawyer so we could make arrangements. We were suppose to get movers early Sat morning but have to push them back to the afternoon b/c she will be moving that day too!!! The most frustrating part is that we wanted to get in a little early to paint and rip out carpets without our DD in the house. Whatever, it is what it is. She is a very nice older woman, I have to just suck it up, I kind of just feel like a deflated balloon!!
