oh man!
1 - When i get home I am tempted to walk around the corner and give her a yelling to and smacking. This is insane. i saw her out there the other day and wanted to yell at her for everything she had put you through. this is nuts.
2 - Close as soon as you can... that gives you more leverage in kicking her out.
3 - Don't change the delivery of the appliances... but maybe have the lawyer do something in case they get damaged. If we can help in anyway... (i.e. store a fridge in our garage for a couple days) just let me know neighbor!

I've been thinking about it all day. her lawyer told ours that there is a delay because her purchase has a CO issue. Then why is she agreeing to close on 7/15? The CO should affect closing NOT her living there. Its all BS. Im just afraid that she is going to ride this out as long as possible. We are planning to close on 7/15 and then she will pay us. Im fine with that (i dont really have an option) I just do not trust that this woman will be out by 7/29
For all i know, she we not go through with the purchase of the house and then she will need to find a rental which will delay things even longer. Nothing can ever be easy but I guess thats life. It just sucks living out of boxes with a 14 month old So jaded by this whole experience. I am NEVER moving again

ok so i spoke with my lawyer. she will pay $70 per day for the five days after closing and then an additional $100 (so $170) per day for the remaining 9 days.
the other question - we just bought new appliances which have rebates valued at $1500. We MUST take delivery by 7/29 to get the rebates. Now what? If she isnt out on the 29th to have them delivered, we are out that money? Can we have them delivered while she is still there and then hold money in escrow incase she damages them?
omg, such a mightmare.
I have become the most overly cautious person now when it comes to this stuff but can you get a refund on the appliances. Cancel your order and cover your butt! Your deal isn't done until you have closed and have keys. Don't spend a dime on that house or anything pertaining to t until afterwards.

What your lawyer told you is correct. Unfortunately, it's you either go with it or you walk from the deal.
When I had this happen with my clients, I made them take out an additional insurance policy, like a renters policy, for the time the seller remained in the house. It was like $40 or something but if you think she is shady, do it for your own protection. Call your homeowner's insurance and find out about it. Your new appliances may fall under it as well.
Also, are you renting right now? Your lawyer should be negotiating that the seller be paying your rent for the time you can not take possession of the house.

Not for nothing but if you close 7/20 and she is renting from you after it's your home. Why would you refuse to have it delivered after 7/29? It's YOUR home! Have it delivered and put in the garage.

I'm sorry you're going through this, Karin We dealt with a nightmare seller also who gave us a really hard time to schedule the closing too. We were told the only recourse we had was to wait until they broke contract by not closing by 6/20 and walk away with our deposit. We loved the house so obviously that wasn't an option. It infuriated me that the buyer is the one forking over all this money yet has ZERO say!!!

thanks everyone for your advice and sharing your experiences ...
so we wait to hear from our lawyer. we are hoping to close next friday and then we just that she really DOES move out on 7/29 like she says she will.
there is nothing else we can do. she will pay us rent for the days that she stays in after close. ugh. i just want this to all be behind us and as many of you have said ... it will be worth the wait. At least, thats what we keep telling ourselves.
Hey, at least she is paying for my new appliances with her rent

There is NO WAY she can stay for free. Even for 5 days.
You also DON'T have to accept those terms at all. You are NOT required to let her stay 5 days.
So you either agree for her to stay and pay you rent FROM THE TIME you close, don't agree for her to stay and still keep the closing date or you modify the closing date for her to get the hell out BY that date.
But she needs to understand that she SHOULD be out of the house by a closing date. She should be ALL PACKED UP. Not waiting for the closing date.
What is the reason for her to stay in the house?

I agree with the additional insurance. Like what if she breaks something or burn the house down.
