FMLA and NYS disability are two entirely separate things. Your company has to pay into disability to get disability and believe it or not, some don't. FMLA only requires that your employer allow you to take 12 weeks off UNPAID if you have worked there at least a year and have worked I believe 1250 hours and they have 50 or more employees.

Oh, and that six weeks of disability is actually five weeks since they have a week waiting period. I got a total of $825 for maternity leave. Pathetic really, but what are you gonna do?



Oh yea, totally forgot about the one week waiting period. It was 5 weeks disability pay total. That really screwed things up for us because my paperwork "got lost" at my OB's office and was submitted nearly 2 weeks after I gave birth. Then I had to wait a week, then I got about 2 weeks worth of disability pay. I had to fight with them to get the full amount I was entitled to.

Wish I worked for company with a D A M N handbook so I would know. I work for a small family owned business. I have NO IDEA if they will pay me for maternity leave or not. And we do not fall under FMLA because we are only about 25 full timers.

Also, in the recent past several of us had asked about AFLAC and for some reason my boss seems against it even though it would cost him nothing. So now I am up that proverbial creek.


After the new year, I will be asking to have a meeting with the bosses and ask to be told if they will give me paid maternity leave or not. If so, we will be fine for the 6 weeks. If they won't be paying me, we will start stashing every penny away.



Sounds like my company as well. I'm scared to ask them though.

I did not get paid maternity leave at all. I was able to use up my vacation and sick time, and then nothing. however, I did get state disability - while it helps, its really nothing. $170 per week, minus taxes. You can't live on that!

So it seems to be that I should not feel badly if they don't want to pay me because a LOT of people don't get paid leave.

The worst thing is.....my family & friends say "Oh just use your vacation time & sick time". Sure....all I get is 2 weeks vacation & 1 week sick. No carry over either. And my vacation time never increases (again another disadvantage of small family owned businesses).

I live in IL and we don't get any disability pay. Only 1 of the 4 companies I've worked for offered paid maternity leave. They gave 6 or 8 weeks paid and then you could take accrued vacation time.

Man, its a drag to hear everyone talk about how poor their companies are with this. In the UK we get 6 weeks at 90% of your pay, than for up to 9 months you get Statuatory Maternity Pay which is (I think) £114 ($230 ish) a week. Your company also has to let you have up to a year off and they have to either hold your job or offer you a comparable role. Its a fantastic deal.....

Yeah I can't complain in that regard - as of right now I have been working about two years here and I have 23 vacation days ( I can carry over 30) and 24 sick days and I can carry over all of them so thats over two months I can take off paid AND I am nowhere near trying to TTC

by the time I TTC ( God Willing ) I should have three months in vacation/sick to use up but first I am going to try to save up to take three months unpaid and then three months paid. . . . but who knows what will happen then!

My company claims they will honor disability through FMLA. But, I am hoping they will allow me to work at home.

I was dissapointed with my maternity leave but after reading these posts I feel a little better. I can take 12 weeks off but I will only get paid for 6-7 weeks...full pay though.

My company is global with our world hdqts in London. My counterpart (the London Marketing Director) just left on Friday for mat leave and she isn't even due until the end of next month!! She is taking a full 12 months off. She won't be paid for 12 months but they hired a temp and she will get her position back next year. She was telling me how great the mat benefits are across the pond and couldn't believe how poor they are in what is consider the world's richest country. It's nuts really!

She might not get paid by the company, but the government pays her Statuatory Maternity pay for 9 months. (our firedrill went so I didn't finish this) Your company may only pay for for 6-8 weeks, but the taxes that she paid will pay for her SMP for up to 9 months. I had 13 months maternity leave, I finished over a month before the baby was born, that was saved up holiday, and then I came back when my little boy was 1. I walked back into my job and I got an 18% pay rise....

My company had no maternity leave either. It's not against the law if it's a small company and at the time they were. Under 50 they have the right to do nothing. I didn't really care, they treated me well and gave me a package as I was leaving for good anyway.

I am covered under FMLA. My company is based in OH so not sure what I am entitled to-does it go by your home state? I am in sales so I have commissions coming in all the time and I believe I will get NY disability plus commissions so about $600 a wk?

It's the same with my company - you get NYS disability (6 weeks for v-birth, 8 weeks for c-sect) but we don't have paid maternity leave.



Same here we made sure we saved up my salary for 2 months throughout the pregnancy so I can stay home and not have to stress about bills.

the State would hold my job for a year, so it isn't that, but we'd have to be able to live on DH's salary and what little I would get from disability.

I know it *****, it really does, but if people were told they would have to pay substantially more in taxes to pay women more in Statuatory Maternity pay, I think the US citizens would be up in arms about raised taxes.

Excellent point. Citizens of European countries with state sponsored maternity packages also pay a significantly higher percentage of their salary to taxes. So, it probably balances out since we are not as heavily taxed our entire career.

You should check your company's policy on leave. Employers are allowed to require you to substitute paid leave (sick days and vacation days) for unpaid leave. The paid leave would run concurrenly with the 12 weeks of unpaid FMLA leave.

I don't have kids yet, but I definitely think about this issue. I'm not protected by FMLA at my firm. I have no idea whether they provide any paid time off. I hope to at least be able to take 12 weeks of unpaid leave. Also, in CT where I work, employers aren't required to pay into the disability system. Maternity leave is really awful in this country.

My company depends on how much time you are there.

THey allow you to leave 2 wks before the delivery date then if you are there less than 4 yrs you get 100% salary for 4 weeks and then 2/3 of the salary for up to 22 weeks.

If you are there more than 4 yrs, you get 6 wks 100% salary + 2 weeks for every year of service past the 4 years. and 2/3 salary up to 26 weeks.


If I get pregnant and deliver next year, I will have been there 3 years, so I will get 4 weeks paid leave, plus 3 weeks of vacation time, plus the 6 days vacation I am rolling over from this year. So it will be about 2 months paid 100%. After that i can take more time at 2/3 pay.

They have a pretty good policy, which is why I am still here.

That is why I had to save up both times BEFORE we were ttc to be able to stay home for 3 months. The disability money was a freebie then for us.

NY State only pays $170 week, maximum for disability for having a baby.

An Aflac rep spoke at my job last year and I asked about this. She said it does not cover a "normal" maternity leave. It only covers you in the event of extenuating circumstances.

I'd double check with an aflac rep just to be sure.



AFLAC definitely covers maternity leave. I had a normal C-section delivery and was paid by AFLAC for all 8 weeks.

I believe there is a waiting period - meaning you can't already be preganant or get pregnant within 3 months (I think) of signing up for their benefits. Check out their website for info www.aflacny.com
