Sounds like a hate crime to me...you were targeted because of your skin color. No different than when it happens the other way around. As for getting punched...that is harassment in NY. I'm so sorry you had to deal with this...and I'm sorry no one had the balls to step up and help you...

Sec. 485.05 Hate Crime
A person commits a hate crime when he or she commits a specified offense and either:

Intentionally selects the person against whom the offense is committed or intended to be committed in whole or in substantial part because of a belief or perception regarding race, color, national origin, ancestry, gender, religion, religious practice, age, disability or sexual orientation of a person, regardless of whether the belief or perception is correct, or
Intentionally commits the act or acts constituting the offense in whole or in substantial part because of a belief or perception regarding race, color, national origin, ancestry, gender, religion, religious practice, age, disability or sexual orientation of a person, regardless of whether the belief or perception is correct.

S 240.26 Harassment in the second degree.
A person is guilty of harassment in the second degree when, with
intent to harass, annoy or alarm another person:
1. He or she strikes, shoves, kicks or otherwise subjects such other
person to physical contact, or attempts or threatens to do the same; or
2. He or she follows a person in or about a public place or places; or
3. He or she engages in a course of conduct or repeatedly commits acts
which alarm or seriously annoy such other person and which serve no
legitimate purpose.

I feel so bad. Sounds like the lady I bumped into accidentially on the subway two weeks ago. She totally went nuts on me when i rubbed her arm when i got on. She did the whole "white girl" thing too, totally going off on me....Bad enough I hate commuting and now I have to be careful not to lightly tap someones arm?? Ugh....again, I feel for you, been there......

I was actually just thinking, I wish I had pepper spray with me. It's illegal to buy it or ship it to NY though, even though it's technically legal to carry it. Do you have pepper spray?

Good lord. I want to say I can't believe that happened to you but I've seen enough crazy shit on the subway over the years that sadly, I believe it all.

I'm glad you're safe...that's really all that matters at the end of the day.

Your DH probably made that comment because he was upset about what happened to you...people say stupid things when they're upset.

As the PPs noted, it sure sounds like a hate crime to me.

It totally sounds like you conducted yourself in the best possible way to secure your safety... Some people are just bat shit crazy.
And if it were I in that situation - I too would have said something...I have no tolerance for people being rude and nasty.
You were harassed and assaulted so I really do I hope you do file a report..
I'd have kicked my DH in the shin if he said what yours did.. Chat Icon

please stop feeling this way. you are lessening the seriousness of what she did.

what she did was a hate crime and it was ASSAULT...furthermore...pushing you towards the platform edge could be considered even more severe. do not reduce the severity of this. If the person you speak to doesn't take you seriously, speak to someone else. This cannot happen. You might be helping someone else by helping to nip this in the bud and bring attention to it.

Wow..I would definitely file the report!! It can only help to support your side of the story should this crazy, psycho beyotch decide to post this on social media and god forbid, it goes viral.

Sounds to me like she wanted to provoke you. It doesnt surprise me, I used to ride the subway to midtown every day when I worked in the city and these pack of animals would get on the "A" and "J" lines with their cell phone cameras deliberately pointing it at certain people, then would barrage them with insults hoping to get an angry reaction..They they could hit the RECORD button just so they could claim they were targeted by that person..Chat Icon

Not too different from that biker incident with the biker brake-checking the SUV hoping they could just file an easy police report claiming they were hit by the SUV when they deliberately provoked the driver into hitting them just so they could file a lawsuit and extract an easy settlement payday $$$$ from the auto insurance company.

These people are total scum. I used to handle these personal injury suits with these low-lifes who would walk into Macy's with dripping ice cream cones and then deliberately trip and fall inside the store so they could file a lawsuit..It makes my blood boil just thinking about it..

If possible, go to the local precinct near the subway station where this incident happened, and file the report. Get a copy or confirmation number and just keep it around just in case this thing blows up...better to be safe than sorry..

And I am so sorry this happened to you...this type of behavior from other subway riders is despiicable.

I know you're right and I'm definitely going to file a report. I know it was serious, it felt serious to me. I just haven't ever had a very good experience with cops before. The ones I've encountered haven't been the most helpful. I'm going to report it though.

there was a lady who used to come into the store i managed every couple of months to sell pepper spray. I wasn't aware it could not be sold or delivered in ny. But if you really feel like you need it. I could find her info. it's the kind that can be seen under black light to make police identification easier. I have bought it before since i had to go out to my car at night in parking lots.

Thank you- she was definitely trying to provoke me in the hopes that I said or did something she could use against me or post on the internet for laughs. It's disgusting.

I didn't think of going to the precinct of the train station where she got off the train, but that makes sense. I'll do that.

That's okay, I do have one cop friend who might be able to help on that front. But thank you, and I'll keep it in mind. Yeah, it's one of those weird laws with loopholes. I only know because my friend was mugged a few years back and I looked into getting it for her.

I'm sorry you had to deal,with that crazy ass todayChat Icon it's awful commuting into the city. There are so many mentally ill people walking around. I've heard many fights where someone gets called a cracker, honky etc. a black man screamed at me for no reason and called me a white ***** Chat Icon I called him something very nasty right back bc I was furious! I find that when something is happening on the train, no one says anything. It's the only place in the world, I am surrounded by people and feel 100% all alone. I feel for you, I think you should file a report if you can.

As for your DH, does he go Into the city? Logically yes, he is going to say you should have said nothing because he doesn't want you to get hurt. But sometimes you just can't help it and you blurt out whatever.

It's very stressful, and I always hated commuting into the city bc of the lunatic factor

Wow, reading this totally put me into your shoes!

I am so glad you made it out of the situation safely.

I was on a train once that was packed and leaned up against a black woman not intentionally and got the same kinds of things yelled at me. I was fortunately travelling with someone else though so I felt a lot more at ease.

I think on the subway, most people are afraid to get involved because you don't know what a nut like that is capable of.

When I used to live/work in the city, I once saw a guy get stabbed on the train and it really affected me.

It was during the work day and I went back to my office extremely shaken up and most of my co-workers just shrugged it off, so I can only imagine how you must be feeling right now, with her putting her hands on you.

Don't be afraid to talk to someone about this as well if you need to.

P.S. I also think she was just out to fight someone and if the Indian man had spoken up too, he would've been the victim.

Yeah, it's a very scary feeling to be alone in a group of people like that. You feel like "Is anyone ELSE seeing this?! Is it just me?!"

DH drives into the city which is an entirely different kind of stress. He rarely if ever takes the train, but he knows better. It was just a pretty insensitive thing to say and I let him know so.

I'm so sorry - how scary! I just read through this whole topic and wondered if the police might also be able to get surveillance video from the platform where you de-borded the train to use to help ID the woman? It depends on the station, but so many have cameras now.

I am right there with you about your feelings on NY. Other US cities are NOT like this. What is wrong with us? DC, Boston, Chicago, San Fran - far more civilized. What is it about NY?
