Taking photo/video of people
Is it legal to take photo or video of someone without their permission? For instance on a train? TIA.

If its not illegal, I think it should be! But I don't think it is bc if you're out in public, then I think your privacy rights may not apply. Which is why all those videos of the police arrests and other events as they are happening always make the news. Think of all the viral videos taken by bystanders or strangers...would they be able to be aired all over if they were illegal? (Genuinely asking, not rhetorical-haha).

I recall that complete ***** who was acting up on the train and bugging the LIRR (?)worker......someone filmed it.......it hit the media....in the video, she kept saying how she went to a great college and how educated she was.......let me find it.
all that aside - not sure. might be one of those murky laws.

What would you guys do if someone got in your face filming you? I mean, the phone an inch from your nose, while cursing you out, on a crowded train between very long stops? I just honestly don't know what the right thing to do would be in that situation...

It's a solid 10 minutes between stops, you're not on a conductor car, and the train is crowded and you have nowhere to go.... This is the subway, btw.
Eta: this is also a train where the doors are locked so you cannot move freely between cars, even if there weren't 20 people in your way.

Yes - it would be illegal to grab the phone away. It could be considered illegal even if taping was illegal (and I'm not sure if it is or not, but I lean towards no).
As for what constitutes harassment, I guess it would depend on more of the circumstances, like what caused the taping in the first place.

I don't think think there was any way to diffuse the situation- the filmer was belligerent and out of line IMO.

As for what constitutes harassment, I guess it would depend on more of the circumstances, like what caused the taping in the first place.
Here's the situation: a young woman gets on the train and stops, standing directly in front of the door blocking everyone's access to the train. An older Indian man tries to get on behind her and she gets in his face, cursing at him and saying "why you in my face? You gonna do something?" The man enters the train and says nothing else, still being harassed. The subject of the video enters the train after the Indian man and says "well, he's right, you really should move into the train, you're blocking the entrance." The filmer begins filming the subject in a belligerent manner.
Eta: the subject hid their face and tried to ignore the filmer but they were quite persistent, moving the phone around the book the subject was holding in front of their face and holding the video an inch from the subject, all while berating and cursing at the subject.
Etaa: the filmer was also hurling racial epithets at the subject like "white devil" and "cracker". Not sure if that makes it more like harassment- I know we only like to look at racism coming from white people, but I truly believe this was a racially motivated altercation, at least from the filmer.

I'd truly like to believe this... But in this world, right now, with all the sense of entitlement and nobody taking responsibility for their actions... I'm afraid they might be.

Are you kidding me? I mean, that's not the type of situation I'm talking about at all, but I find it hard to believe that in your own home where you have a reasonable expectation of privacy that this would be okay.
