Maternity Leave

So my understanding is that NYS requires every company to have Short Term Disability and STD allows you benefits for 6 weeks for a vaginal birth , 8 weeks for CS @ $170 /week.

(P.S. Are they serious with that number? In a state with generally high salaries and a very high cost of living that is ridiculous. Chat Icon )


So whats the deal with disability thats offered through your company (not the NYS mandated one) -- is that something you pay in to while you are an employee? An optional benefit offered by some companies?

I dont think I have disability through my office except for the NYS one-- but I am not ready to ask the office manager yet since I havent come out at work..

Just wondering how this works so I know what to ask *(Office manager is NOT very knowledgable!)

Also, do you get paid maternity leave in addition to that at your company?

I have to use up all my time... sick and annual and then w/o pay.

ETA: what about FMLA.. I'm not sure it works, but I think you are allowed to take an additional 12 weeks w/ pay (not sure) to care for an immediate family member.

I have short term disability through AFLAC that I pay for wkly with a p/r deduction. This is completely optional. They will pay me 80% of my salary for 3 months, beginning 2 wks after I go out on leave. I have the deduction made after taxes, so the benefit will be tax free at the end of the year. I am also eligible to collect NYS disability.
When I signed up for this policy, I was told that I can not file a pregnancy claim within the first 10 months of my effective date. They want to make sure you are not pregnant when you sign up.

Im in Virginia and we do not have a mandatory STD law.

I pay a small amount out of my check each month for the STD that my company offers. This will pay me 70% of my salary beginning after two weeks.

I am only taking 8 weeks of leave.

same for me (except not AFLAC), here, you have to enroll during open enrollment though and the same thing for me, you are not eligible to enroll if you are already pregnant. I pay into it every week, and it will pay me 50% of my salary for 8 weeks in addition to the NYS disability of $170/wk.

I also have a plan like this through All State and I had to sign up during open enrollment. You could not get pregnant for a year to be eligible for benefits and they will pay up to $2000 a month. I will also have NYS Disability and whatever benefit time I have.

I too have a STD policy through AFLAC that I pay the premium through my paycheck. As others have said you have to be on the policy for 10 months before you can put a claim in for maternity leave. I also get the NYS one at $170 per week. My company does not pay or offer any other paid maternity leave and since we are under 50 employees FMLA does not apply to us.

Thanks ladies, my firm is under 50 employees as well so FMLA does not apply here too. But FMLA only allows for unpaid leave for 12 weeks, it doesnt offer paid leave.
I guess its too late to sign up for a STD policy =) But I dont think my company offers it anyway.

Im with you B, I will have 2 weeks vacay for 2011 and hopefully i can use 2 weeks vacation for 2012 (one of the few upsides of a December baby!), will probably take 7-8 weeks unpaid.

I get 10 weeks with full pay and 2 weeks unpaid. Then I have to use my vacation and personal days to extend it. I'm planning on taking a total of 16 weeks and 2 of those weeks will be unpaid.
