I am an untenured teacher. I spoke to my union rep today about my upcoming leave. I thought b/c I was untenured I was only able to get 12 weeks under FMLA. However, she informed me that my contract states ALL teachers (tenured or not) can take 2 years unpaid childcare leave!!!!!!!!!!!!Chat Icon Chat Icon Chat Icon Chat Icon

yeah but since ur untenured...they dont have to hold your job for u right??? they can find someone else and not ask u to come back

No, the contract states that ALL teachers are entitled to 2 years childcare leave. My union rep said they would just push back my tenure date and if there were budget cuts i would be in trouble

This is not necessarily true. The deal with tenure is that you are guaranteed a position when you return to work; untenured teachers are not guaranteed a position when returning to work.

Each district is different, but just be careful because nothing is guaranteed if you don't have tenure. Yes, right now they might say they'll push back your tenure date, but there's nothing contractually that binds them to do so. If something changes in the time that you are out, they owe you nothing.

Good luck and just be cautious.

also, i don't know if you're in the nyc schools, but we just got big budget cuts and they're excessing teachers. just be aware of all the possibilities. (i'm in the same position as you, so i'm trying to research everything.)

i agree 100%. and your position is not held. you can be put back anywhere in your certification area.

I think every district in NYS is going to be experiencing budget cuts...so that would definitely concern me. Good luck!

Yeah, I would be careful. If they are doing cuts and you are on a 2 year leave, you may be the first to go. I have been teaching in my school for 7 years and I am only taking 12 weeks, partially for financial reasons, but also bc of cuts.

Knowing what school district you are in, I definitely wouldn't take the chance. They constantly excess teachers for no reasons! Heck, I was nervous and this was my first year of tenure! I didn't even tell anyone I was pg until I was approved by the board for tenure!

ITA! I hate to be the negative one on this but as a union rep in my district I agree with T, you have to do your homework. Usually they will push back your tenure date but if there are cuts made, you could be cut.

Just be careful. We are heading into a financially unstable time with the state budget and the percentages that the districts are getting in aid. There is a chance that positions could be cut in the future.

Look out for yourself.

I am untenured and currently taking a full year leave. I also took 3 months when my first son was born. Both have pushed back my tenure date, but I do have a job to return to in Sept. Now as far as cuts, nothing is guaranteed, but I would be in the same boat had I taken the leaves or not.


ETA: They do not necessarily have to hold your job, but if you have had good observations, and there are no cuts, you should be fine. Do whatever is best for you and your family!
