I think it's hard because, where do you draw the line? If someone smokes pot, should they be denied admission? What if they once got pulled over for DWI? It's a slippery slope.

Yeah, but those things are illegal, posing nude isn't. I get your point, but still, posing nude is legal.

Ok so Ive got another situation along the same lines for ya:

What about our very own President who took cocaine before he was appointed?

Should that be considered any differently than posing nude????

I think it should be considered different

Cocaine is illegal

Posing nude is not

Exactly. I can't understand how people are trying to equate drugs and posing nude.Chat Icon

i agree that it's a matter of DISCRETION to not do these stupid things in the public eye

but i still don't think it should prevent her from being barred

i don't care if she shakes her boobies in the courtroom - my taxes aren't paying her salary

I agree.

But just so you know, I would never pose nude, but I doubt anyone from Playboy will be knocking on my door anytime soon Chat Icon

ETA: I still think it was pretty stupid of her tough!

She certainly has a right to pose nude, but she should think about the consequences of her actions. Not only could this affect her being able to practice law, it could harm her reputation as an attorney if she were admitted to the bar.

Obviously she could've done something much worse. This is questionable behavior though that IMO warrants some type of further investigation into her character.

In terms of the legal/illegal distinction, other people have been denied admission to the bar based upon their beliefs. Matt Hale, a leader of a white supremacist group, passed the Illinois bar in 1998, but was denied admission based on his racist beliefs. Although different than posing nude, Hale didn't commit an illegal act (at least not at that point - years later, he was convicted for soliciting the murder of a federal judge). While hateful (and disgusting IMO), he simply exercised his freedom of speech. The Illinois Supreme Court upheld the denial of admission. I know this is an extreme example, but the legal/illegal distinction doesn't really matter in terms of character and fitness requirements for the bar.

Re: I've got a Wednesday Night Debatable Topic for You!!

Here is the article from today's NY Post -

A Brooklyn law student who took it all off for Playboy TV has only herself to blame for the scandal, her ex-boyfriend told the Daily News yesterday.

Adriana Dominguez, who's in her final year at Brooklyn Law School, blabbed about her sexy exploits all around campus, said former flame Sean Kalish.

"She told everyone in school, 'This is what I did, watch this,'" said Kalish, 25, a fellow third-year student at the school.

"She even posted a link to it in her MySpace [online profile]," he said.

Kalish was dating Dominguez, 24, last July when the brainy blond answered an ad to appear in an episode of the Playboy TV series "Naked Happy Girls."

In a photographer's test clip that has circulated online throughout the city's legal circles in the last three weeks, Dominguez happily strips and poses with gavels she won in college debate competitions.

Kalish has a brief cameo - praising his girlfriend's behind and slapping her back side playfully as she lies draped across his lap.

"That was kind of a hipster couple. He didn't expect to be photographed, but he was fine with it," said photographer Andrew Einhorn, also a producer on the show, which re-airs this month and next.

Kalish told The News he regretted his part in the nude romp.

"It was definitely not my wisest moment," he said at his Manhattan apartment building. "I already have a job lined up. I'm hoping my employer doesn't find out. I'm quite embarrassed by all this. I wish it didn't happen."

He called his ex "smart," "beautiful" and "creative" - but not exactly demure.

"She kind of thrives on this kind of drama," he said.

"I wish that Adriana had been a little more discreet about it," Kalish said.

The couple dated for about a year and a half before breaking up.

Dominguez, who said Monday that she never expected the clip to become so widespread, was hiding out in her downtown Brooklyn dorm room yesterday with her roommate of three years.

"It's upsetting for all her friends. It's a bad scene here," roomie Raven Dorantes, 27, said. "She's done nothing wrong."

Law blogs and Brooklyn Law students were split over whether Dominguez's one-time striptease should affect her law career.

"She should have known better. Everything affects you in law school," one student on campus said.

But her boss doesn't care what she does with her briefs in private - as long as her legal work is solid. "This isn't something you see in the papers every day," said a bemused Chip Gray of the nonprofit South Brooklyn Legal Services, where Dominguez is an intern.

"I don't care what she does when she's not working here," he added with a laugh. "I can't imagine anybody would take it too seriously, but you never know in this world."

Kalish wasn't as relaxed about the ordeal.

"It's definitely not the kind of attention I wanted. This is a conservative field and this is probably not going to do good things for her. It's not going to do good things for me either."

Honestly - I think this makes it even worse now - being spanked on this video and saying how she likes being spanked and all of that? It was a video - not just nude shots. And if she did in fact tell people herself, well, she's just more of a moron than I thought!

Re: I've got a Wednesday Night Debatable Topic for You!!

before being admitted to the bar, you have to go for a character and fitness interview.

something like that girl did would not get her through character and fitness.

Exactly - is it illegal - no - but it goes against what her desired profession is looking for in terms of character and she should suffer the consequences.

I completely agree with this. As a member of the bar (who has never posed naked and never would) I think this is a personal moral issue and not a professional ethical one.

Oh and I totally agree about the cheating on spouses thing, you can't be not admitted or disbarred for that.

Let's stir up the pot a little, some people think being gay is immoral and unethical (don't flame me here, because I don't believe that, just playing devil's advocate), can we prevent someone entrance to the bar for being openly homosexual?? NO WAY!!!

exactly, I agree, which is why it seems odd to me to deny her admission to the bar, but allow admission to druggies and drunks...I understand that the posing nude thing was "public" but I just don't think it should make a difference

Dumb move on her part.

But I don't think that this should affect her professionally.

There are enough law school students who cheat on exams. Not exactly in the same realm, but if you're talking about character...Chat Icon

Back a bunch of years ago, there was a female funeral director who did this......posed with caskets & stuff.

1st thing that bothers me is that she makes light of a very serious job by doing thisChat Icon

2nd is she is a FEMALE Funeral Director, something that at the time there were so few of and she made them all look like trampsChat Icon

So this law student doing this seems somewhat the same to me. It does not put her in an ethical light.

Am I the only one who doesn't give a crap who poses nude? Who cares? Maybe the gavel up to her tatas was a bit much, but why does anyone care that she posed nude? And what does that have to with being a lawyer? Maybe I'm just dumb, but I don't care if my lawyer posed nude. Hell, I wish I had a good enough body to pose nude!

ITA. WHO CARES??

Listen, there are plenty of attorneys who do worse than show their boobs. Honestly. WHY is it the bar's business where she shows her boobs? Maybe it will cost her clients in the long run, but that should be her punishment, not being kept from being a member of the bar.

Re: I've got a Wednesday Night Debatable Topic for You!!

when other people start judging morals, the world becomes a scary place.

was it smart of her? no. but it's not illegal and should NOT be front page news! give me a break--aren't there any murders to write about?

it's the same thing with teachers--the news loves to print when someone does something. i'm a teacher, not a saint. what i do in my private time makes no difference to my job UNLESS it interferes with my duties.

and the kindergarten teacher thing--as a previous kindergarten teacher, i have to tell you that just because you teach K, doesn't mean you are innocent as a Kindergartener. we are human you know. Chat Icon

yes - but when you work in a job that expects a certain ethical or character level, you do run the risk of your private life affecting your occupation. Whether or not there are a zillion druggies and cheaters who were admitted to the bar - people are saying there are certain character and ethical standards you need to uphold - if the others slipped on through - that was their luck - they probably also weren't doing drugs on an internet video.
