PtO question

Is an employer allowed to deny you to use PTO that you have accrued? They will not payout or let you carry over unused PTO. In NJ.

Another employee put in for PTO and is being denied the days off for supposed poor work performance. I have never heard of an employee being denied PTO that they already accrued because of poor work performance. Not once has poor performance been ever brought to this employee.

Another employee put in for PTO and is being denied the days off for supposed poor work performance. I have never heard of an employee being denied PTO that they already accrued because of poor work performance. Not once has poor performance been ever brought to this employee.



I've never heard of being denied due to work performance, we are all entitled to PTO. My supervisor will deny if she already have 2 people on the same day off. I think this is her own rule not company but people call out if she denies them based on that rule. I did for my birthday. I never call out and decided that's a BS rule and she factors in people will call out of leave early..

adding, I only worked for ONE company that was a use or lose. The company I work for now only allows 10 days to carry over, if you have 11 going into the new year I would lose one day of pay and time

Look at the company manual or ask HR

This. We have a problem employee and while she’s never been denied PTO, we have refused to move deadlines to accommodate her time off. These were not advance requests, she was asking to take a week off the Thursday or Friday before.

This employee gave over a months notice and after that specific time was denied, they were then told that due to poor work performance they we not entitled to use the remaining accrued PTO. There is a month left in the year which give plenty of time to use whatever they had left. This would be the ONLY time in the company an employee was denied for poor work performance. There is nothing in the handbook that addresses that.

Sounds like they are trying to push that person out the door.

Not saying it's right, but where I work a deadline is a deadline. They do not care if you are on vacation, the work has to get done and if it doesn't, it's on you (none of us have backups). I am losing 3 days of vacation this year because the work has to get done. I have worked from Disney World, my Aunt's hospice room, the car... I am on vacation today and working. If she isn't getting her work done or her performance isn't up to par, I understand them not granting her vacation.

Really depends on what the company's policy is. I remember at an old job of mine they would not pay me the PTO I didn't use because I was at the job for less than a year.
