so angry with SLEEPYS

We purchased a Kings Down mattress in 2005 for about $3500! We have hated the mattress after having it for less than 1 year. It is so soft and literally has sagged where we sleep so there is absolutely no support.
We called them last year and they sent someone over to inspect it. They told us that under our warranty the mattress would be considered defective if it sagged 1.5 inches, and since it only sagged 1 3/8 they couldnt do anything about it
I had them come out again last week and they just called me and said, that yes, my mattress is now considered defective since it is sagging 1 3/4 inches, but bc there is a small stain on it (i didnt even notice it, they are sending me the pictures the inspector took to show me what they are talking about it) they cannot honor the warranty and the best they can do is offer a discount (btwn 15-30% on a new mattress depending on the manufacter, but most of the name brands dont apply to the discount).

Does anyone else think this is BS?? That mattress was expensive and they admitted that it is defective. Now they said that bc of the stain they found they wont honor it??? WHAT a scam!!!!!
Is there anything I can do???

ETA: if you search online there are so many complaints of the same issue -- sagging mattess and Kings Down always finds a way to get their way out of replacing it. So much for a lifetime warranty huh??
Also, the 1 3/4 in depression the inspector measured is with no one on it. Imagine what it is like when we are sleeping on it it!!!!

EATA: We also purchased the mattress pad they sell with the mattress so what does that say about their pad if there is a stain?

they told me that when I bought mine from them in July

he flat out said a stain would void the warrenty

I think it's kings down- not sleepy's- I also have a kings down

I would call kings down and see what they say

(or try to remove the stain if it's small...)

Sleepys will always have an out.

i had a friend that worked for them. they refurbish your mattress, but can't resell it with a stain on it.

hence, the void in warranty.

They flat out say in the beginning, when they try to sell you their mattress pad, that a stain voids the warranty.

I just bought a matttress from Macy's - they made a very strong point of telling me that ANY stain voided the warranty. It doesn't make sense but they made their policy clear.

BTW - when we got the mattress they suggested a bed frame that has at least 1 extra bar down the middle for extra support.

Unfortunately this is pretty standard. My grandparents bought a mattress from Bloomingdales that was VERY expensive. Same thing happened to them. They tried to get it replaced but the inspector found a stain smaller than the size of a pea so they were told that their warranty was voided. It seems to be a standard clause at all the mattress places b.c we were told the same thing - when we just got our mattress. We got a good mattress cover just in case - but basically we knew that once it was in our house we would probably be stuck with it no matter what - I'm sure that they ALWAYS find some sort of issue so that they don't have to exchange it.

Do you know the stain is from you?? Could the inspector have made the stain?

we had the same problem! or should i say still the same problem..

we were unhappy with our mattress after 1 year. we called them and they came. sagging and they can replace it. delivery came..said they can't take it b/c of a stain. DH went to sleepys to complain. the lady was nice and recommended the TIDE STAIN PEN. and it worked! we called them again and they came and took the mattress.

we got a credit for our next mattress. we bought another mattress from them. less than a year later...SAGGING again they came out twice and said the sagging was not enough to replace i hate them!

Yes a stain voids the warranty.

I would appeal to them that the mattress was indeed defective all along before the stain was there. You had made documented calls about the defective mattress and now they claim it is defective but there is a stain now.

I think if you fight it enough you can get your way.

Sleepy's delivered the wrong mattress to me from the get go and refused to replace it. My mattress was not even out of the plastic and the delivery person was still in my house - yet they refused to take it back. I threatened to sue. It did not matter. I will never shop there again because of the horrific service.

Try to clean the stain the best you can and call them back again.
My dh works for Sleepys and yes a stain does void the warranty. If you're persistent, I'm sure you'll be able to get a credit for another mattress.

Is the mattress pad that your talking about that plastic sheet they sell for like $100? We have the same mattresss, same problem, have only had it for 6 months, and guess what? I just found a nice stain on it the other day! I was told by the lady who sold us the bed that as long as you buy that cover and register it (which i did) they would send someone to your house to try and clean the stain and if they cant get it out they pay for your new mattress. check that out and update us, now im worried that they wont honor the warrenty when i eventually call them

We had the same exact problem with them a few years ago. When we got our new mattress we made sure we got their $100 mattress protector. This new mattress is sloped too now and I'm sure they'll try and find an out again....

OMG...my mattress is sagging too!!!! Within a few months, I had oner replaced, and then about a year later (maybe less) the same thing, but it was JUST under sagging requirements

I actually bought another mattress because our backs were so bad from the bed...but I still have the mattress....it seems like sleepys has alot of problems with their mattresses...I wonder if we can all get together and see if we can work this out?

I had a problem with my mattress not from Sleepys. I had it replaced only after much aggravation.

It seems the stuffing they use on some mattresses is inferior. They can replace the stuffing it in and it will be better.

My store told me that there were problems with material from China being subpar.

I really think its the way mattresses are made today...especially since they made the "no flip" ones

I've had problems with mattresses from both Levitz and Sleepy's

And, I think all stores go with the "any stain will void your warranty" thing
