Is it really NYS law (preschool/daycare related)
that teachers can not assist with wiping a child that is potty trained? My DD is 2 years 9 months and is in a 3 year old preschool program in her daycare center. She keeps coming home with poopie stains in her underwear from not wiping. So I asked the director today why the teachers aren't helping them wipe and she said its NYS law that unless they are diapering a child they are not allowed to touch them. Really? She's can barely reach, and forget about her knowing to wipe until the paper is clean.
Am I behind? Should she know how to wipe herself well unassisted at 2 years and 9 months?

Nope, they can't do it at my kids school either. They walk them to the bathroom and wait outside, we were told they were not even allowed inside to assist.
I guess I'm lucky that my kids only went/go for 3 hours, so they've never had to do poopy 
I don't think at that age (2-3) they have the full coordination to do it properly. I still check up on my 5-year old at times... He can handle himself, but there's just sometimes its not the cleanest.

I can't find anything in the daycare regulations whatsoever. The department of education is responsible for nursery schools, and those are NOT tightly regulated at all - so I would say, no, it's not NY law, it's CYA.

Not sure if it's the law but it's the regulations at my DD's preschool. I also noticed it's a regular size potty. Which stinks because she isn't 3 yet and doesn't even pull her pants up and down, I do that for her and she uses a potty ring at home. But for now, 2 1/2 hours she is able to hold it in until she gets home.

At my DD preschool they help her completely with the buttons to wiping if they need help. They glove up and assist them. I asked both the teacher and DD..

I would call suffolk county dept that licenses daycare and ask the question.
I have a feeling it is a daycare policy, NOT a state policy to avoid any sexual problem claims.

seriously that is crazy! They are so little, they can't be expected to get on a regular potty without assistance. My DD's class has smaller toilets that are lower to the ground, but she still needs help. I do see them help with their pants, but I always put DD in something easy to pull up and down.
Since this is a daycare she is there anywhere from 3 - 9 hours depending on my schedule so she's going to have to go there.

I dont know if its a "law" or not..but in my Dds preschool, they will not touvh their privates so therefore, no wiping help. They do help them with zippers/buttons and then let the child do their business and wipe. Then they help zipper and button them back up. I think they do wait inside the bathrm with the child..although, my DD asks them to leave and give her privacy.  Thankfully, she only goes 2.5 hrs a day and has yet to poop there, just pee. She does qipe herself at home when she pees, but never when she poops. I always do it. ugh..I can only imagine if she ever has to go at school. Maybe I better start working on that with her.

just $0.02 same is true in Texas
My aunt is a assistant in a head-start program with 3yr olds. She made the mistake of helping a child sit on the toilet and nearly got fired. NO assisting, NO wiping, NO changing. She had two kids this year who pooped in their pants and the parents had to be called into to change them.

That is not a law as long as it is a day care. A preschool falls under different regs. We wipe butts all the time at my day care when they go potty. It stops when they enter our preschool room which are ages 4 and 5, since they are getting ready for kindergarten and will need to wipe themselves then. To expect a child under the age of 3 to wipe themselves properly is ridiculous IMHO

It is a daycare, BUT she is in their preschool program for 3 year olds. Which regs should I be looking at?

If they are only licensed by Office of Children and Family Services then it is the day care regs.

Wow. I worked with 7 year olds when I was a camp counselor. I did not help them go to the bathroom but I saw some of their dirty bathing suits or the underwear that they changed out of when they got into bathing suits. They were very self sufficient kids but I know they were not all wiping very well. That was at the age of 7!!

I taught preschool for years and this is exactly how it ran there too. Also NYS regulated school.

Just an FYI for everyone:
Laws for day cares are different than laws for preschools. If the preschool is in a day care, they are allowed to wipe tooshies

I worked in day care centers in both FL and NY. In the day care centers I worked in, even those with "preschools" in them, we were NOT allowed to help the children with ANYTHING bathroom related regardless of their age. Even if you helped them unbutton their jeans another teacher had to be present to make sure nothing happened. We were not even allowed in the bathroom with them. I don't know if it's law per se but I think most day cares don't allow it as to avoid any possible sexual claims.
