Please help me fight an unfair parking ticket
When DD was born at the end of May, I had some family stay with me. I wasn't sure if my driveway would fit all the cars, so i parked my car on the street overnight. There are no signs indicating that this cannot be done. I got a ticket saying I can't park 2 - 6am on the street. 40 bucks! There are no signs anywhere on my street that I know of. My husband says there are signs on a different street, like 7 blocks away.
My mother did the same thing (parked on my street overnight and got a ticket), she went to court tonight, but they are making her pay anyway! She had pictures to show there are no signs and everything, but the judge said there are signs somewhere. How can they do this? How can I fight this? My court date is in September and I can't let them get away with this! If anyone has advice, please tell me.

what town is it?
I used to live in Floral Park and off street parking overnight is required - there weren't signs on every corner but it was a known rule and not fightable.

Its the same way in a lot of towns/villages. Where I grew up and where my parents still live, there is also no overnight parking on the street from like 2-5 a.m. (something like that, I can't remember). There are NO signs at all, maybe a few on the main road?? But living there, we've always known this and have made accomodations to park the extra cars at the 24-hour meters at the commuter lot down the block.
Sorry, I have no advice on how to fight.

I live in an area with the same kind of rules...i believe there are signs on most of the major roads stating the parking rules...and most of the residence "just know"......Southampton Town fines $75 for the same thing! sorry i'm no help.

If you live in a village, that can happen. Trust me BTDT! You are "supposed" to know the rules. You can ask the village for the rules. No signs needed because you are supposed to know what is allowed or not! yup, I find it crazy ridiculous that people have to find it the hard way!!!!!

it's like making a right on red in NYC. there aren't signs on every corner saying "no turn on red" but you are supposed to know that it's illegal. not knowing is not an excuse.
you can contact an attorney for advice, maybe they can help you fight it.

I agree - this is the same in our town. Some streets have signs while others don't (it's only enforceable between Nov and April though and it's mainly for a potential "snow emergency" overnight.

that's a pretty standard rule.
We always used to put a note on our car that said 'staying at such & such' to avoid getting tickets. Perhaps if you fight it and bring proof of residency, you can get off?

When I started dating DH, I used to drive into Brooklyn all the time and made rights on red constantly. Even DH, who didn't have a driver's license at the time, knew this rule and I didn't.

Yes my village has this and there are signs on the main road, but not many.
For the future, you can usually call the police dept if you know you will need to park on the street and they give you a pass and you won't get a ticket. I think they allow this a few times a year per house.

I got one recently (the day I moved to Long Beach) for parking in a row that cars over 5 feet tall can't park in
no sign- just an empty sign holder- sign 10 spots down
I took pics- and I am bringing my lease to prove that was my first day in the area
I have court on tuesday
it's only $25 - I am fighting out of principle
I am not a mind reader- I never heard of cars over 5 feet not being allowed to park in certain spots- and I can't even figure out a logcial reason why
it's not like it blocks the oceanview- the building across the street does

Some villages do this. In Garden City for example there are signs on every street when you cross into GC saying no parking between 2am and 6am. If you have company overnight or you are redoing your driveway you can get around the law by going to the police station in person and signing in your car. I know for example in Garden City you most likely won't get out of the ticket because they expect residents to know the laws (basically ignorance of the law isn't a defense). I was really sick once with 103 and the stomach flu and couldn't get out of bed to move my car to the lot when I was living in my co-op they ticketed me (I think in GC it is only $20) but even with a doctor's note I was out of luck. You can try to argue it but I'm not sure if your village judge will accept your excuse.

The fact that 1) you had a newborn (easily verifiable by producing the birth certificate) and 2) chose to put your own car on the street (because theoretically, the police could have done a plate search and seen that you the car was registered to the house in front of them) instead of a guest's car, should only help--so play that up.
Those laws are said to allow for street cleaning during those hours, but it's really so that the neighborhood doesn't look like Queens and/or show if a car on the street doesn't belong there (i.e., a burglar's car). Obviously, it was the resident's car, so that has to help.
FWIW, Mmst people get away with it by handwriting "Car Disabled" signs and leaving them on the dashboard.

Is this on Broadway? If you were parked close to an intersection it might be because it decreases visibility for pedestrians and people who drive cars under 5 feet tall.

Wow! That sounds crazy! I can't believe they are going to get away with this. I never heard of the idea that I am "just supposed to know" not to park there. I hope I have a sympathetic judge and I will try some of the suggestions, but I guess I will probably have to pay.
I actually do live on a main road, but don't know of any signs on this particular road.
I am willing to pay for my mistakes, but how am I supposed to know to ask the town about something that I don't know about? So unfair.
Court date is in a month. I will update then.

I was given a copy of the rules as well as my VERY 1st parking ticket on my windshied. That's how I found out! I was venting to co-workers who told me... Oh yeah, you live in a village.
I could not believe I was SUPPOSED to know the rules that never knew existed.
I had always learned that there were signs on the road to tell you those things. NOT in NY!!!!!

Did you park on the same street that your mom did? If so, perhaps you should have thought that since your Mom got a ticket earlier, the same would happen to you.

we are all "supposed to know" our local laws and regulations.
could you commit a robbery and try to use the defense "i didn't know it was illegal"?
i know that's an extreme example but it's the same principle.

I doubt you'll get out of it like others have said its common in many villages on LI. Can't hurt to try though if you have the time & energy to go to court for it.
I'm curious ... did you notice that your neighbors weren't parking on the street overnight?

This is true, but she didn't tell me that she got a ticket!!!!! I don't know why, but she didn't.
