Do I have any recourse?

I was in the hospital in December/January. I was taken in and thought I was having vertigo and was actually having a stroke. I was brought in for an MRI and they took off the earrings and necklace I was wearing. I watched the technician take them off my ears (I couldn't do it because I had no use of the right side of my body and they never asked my husband who was waiting in the ICU). They never gave me a property receipt. The entire thing was so chaotic and when I finally remembered to ask they ran around looking for my earrings and never found them. I asked while I was in the hospital a few times. And then told us to fill out something with security. Which we did before I left the hospital. The security officer said he would look into it. After a while he gave my husband a call and said they had no recollection of me having earrings and we could make an appeal. Which we did. And the appeal was denied. So now what? These were $2000 earrings that my husband gave me for a special occasion. At the time when my earrings were taken, we probably should have made more of a stink. But we were blown away by the fact I was having a stroke and my symtoms did not go away for a few days. I am not sure what to do now. The necklace, I don't care about. I got it as a gift in a $30 secret santa swap. But my earrings I do. Do I hire a lawyer? Small claims court? They never gave me anything and its really at this point, their word against mine. I am sad that I lost these. (But clearly very happy that I am alive with minimal side effects). Thank you for any advice.

Small claims court, a lawyer doesn't hurt. Make sure you have the receipt from the earrings. Does anyone happen to have a picture of your wearing them while at the hospital? What hospital was this?

Can you find out who actually was on staff the night they did did your MRI? I would then contact hospital administration explaining exactly how you put it above & find out of there is another protocol for your situation.

I provided them with the receipt. No one has a picture of me wearing earrings in hospital. I don't even have a picture of me in hospital. It was at Winthrop.

I'm so sorry. That is terrible. Like the others have said, find out who was working in the MRI room. I hope you find your belongings.

If you don't get any help after contacting hospital administrators then file a claim in small claims court - no attorney is necessary. Do you ha e the receipt from the earrings? And any pics of you wearing them (not in the hospital) - those would help support your claim

I personally would sue them in small claims court. Its worth a shot and the time.

but you have to PROVE that they removed them and kept them. Normally I would say to find out who was on that night and did your MRI. Your chart will show that. There HAS to be security video of you entering the hospital with them on as well.

I would call them back and speak to the president or the person in chanrge of the hospital. NOT security. Explain the situation. There has to be security video of you entering with them on. The MRI tech's name would be on the chart. Don;t give in.

But ultimately it might be a big headache for you to prove.

I however would make a HUGE stink to the managing office. Not the flunkies. It was so long ago I am not sure you will get any resolution.
