Patient's Rights

Ok I'm desperate here. My insurance co has canceled my life insurance because a doctor that I saw once two years ago will not send my medical record unless they pay him $250. I think this is exorbitant for medical records but I have even offered to pay out of pocket and they said it must come directly from the insurance company. And although the insurance company did their own physical, they refuse to give me insurance without record from this one doctor appt. I have a 3.5 month old son and the thought that I have no life insurance right now makes me sick to my stomach. Do patients have any rights to their records, let alone having to pay these crazy fees? Anyone have any suggestions on how I can go about getting it? Can I file a complaint somewhere or anything? Help! TIA!

the doctor *can* charge up to 75 cents per page, However, they cannot refuse to send the records for lack of payment (this is as far as patient access to the records though- i'm not positive if its different when the request is coming from the insurance company and is not claim related).

Thanks. I just spoke with the insurance company and I can send them the record (doesnt have to come straight from the doctor) so I'm going to call the office and tell him to send ME the record. Is that $.75 fee/page a law? If so, I'd like to tell him that's all I'm giving him. This feels like such a scam.

The most they can charge you is .75 per page.

As far as I know, they can not legally charge more than .75 cents per page... If they are going to give you a hard time about it try this..........call your Dr. office, tell them your coming to p/u your records....let them know you understand the law allows them to charge .75cents per page and ask how many pages it will be.While there, ask them to put your papers in an envelope.Mail the papers to your insur. co. in their envelope and see what happens........

i know this is the law that applies to Hospitals- i would imagine that Dr's offices would have to follow the same rules...



New York State law requires all health care practitioners and facilities to grant patients access to their own medical records. Section 18 of the Public Health Law contains procedures for making these records available and the conditions under which a provider can deny access. Patients may request information, in writing, as may parents or guardians who have authorized their child?s care.

If you want to see your medical records, ask your doctor and/or the director of medical records at the hospital. New York State law guarantees you the opportunity to inspect your medical records within 10 days of your request.

If you want to have a copy of your medical records, you must submit a written request to the hospital. Address the request to the director of medical records at the hospital. If you request a copy of your records, the hospital may charge you up to 75 cents per page.

Thank you all. Guess who is picking up her medical records for FREE now on Monday Chat Icon See it pays to be forceful because when I quoted that law, all of a sudden they were free.

What makes me sad is that there are plenty of people who wouldn't fight it as hard as I did (like senior citizens) and it pizzes me off that doctors and insurance co's try to rip people off so badly Chat Icon
