Normally I would say an engagement ring is a gift (one that I personally would return)
HOWEVER, "Castellano has threatened to sell or destroy the 3.23-carat ring, even though the couple agreed the ring would be returned to Kuehnen if their engagement was ever broken off, the complaint says.
If she agreed to return the ring if their engagement was broken - then she should live up to her words. Emotions and bad ones at that are making these decisions.

Well the attorney would have to argue that it was a Christmas gift, not an engagement ring.

I agree with Emily post -- the ring should go back unless it's an heirloom from the bride's family.
I agree. It should be given back regardless if the proposal was on/near Christmas.

Being a lawyer, I think bright line rules never work in law.
I was previously engaged, and I kept the ring. Initially he wanted it back, but I would have fought him for it. He eventually came to the realization that for him to get the ring back and walk away scott free wouldn't have been fair and he just let it go.
In the end, the cost to me and my family for lost deposits etc was worth about 1/2 the cost of the ring. The other things he stuck me with that are still costing me money to this day, cost me way more than the other half. He came out ahead. If he had fought me on keeping the ring, I would have sued him for every penny I lost on everything else and it would have been downright ugly, I'll admit and I'm confident I would have won on most id not all of it. He got off easy, bottom line. I'm still picking up the pieces (financially not emotionally)
Of course, my ring wasn't worth as much as this couple. It wasn't a family heirloom etc.
I think no judgment can be made until all the fact surrounding the incident come to light.

i would return the ring, but if the guy gave me a hard time like cheated on me or what not i would keep it a bit longer make him sweat then give it out;

Judge Judy ruled on that once.
I needs to be return UNLESS it was given at Christmas or birthday, then it's concidered a gift and does not need to be returned.

I can't see keeping the ring- unless he stuck her with the cost of a wedding and ran off at the last minute. Other than that- no way.
I broke off an engagement and returned the ring pronto.

Did anyone notice that the article just says a $48,000 ring - not a ring that he paid $48,000 for - I wonder if that amount is the appraised value, or what he actually paid.

I believe I learned in college that an engagement ring is a form of a contract, and that contract is marriage.
No marriage, ring goes back to the purchaser. The contract has been broken. YES!!!! I learned that on Judge Judy

ha! regardless!!! Appraised for 50k or not, it STILL has to be worth in the 20 thousand $ area... I don't know about you, but my ring is LOVELY and it was DEFINITELY not 20k...
