PERMITS & CO'S

We are trying to get to closing on a house we are in contract on and a bunch of open permits just came up.

Upstairs Bath
Garage
Back Porch

The permits were all applied for back in the '50's & '60's but I guess never followed through on.

They are offering us a credit at closing.

How hard of a process is it to finish up the permit process??

Who can I call at the town to get more info??

Call the town assessor's office - they'll answer all questions you have and give you a better timeline.

just realize that permits for these structures may mean higher taxes once all is said and done.

Also, you may have to do extra work in order for it to be up to code. (I believe).

we are going through the same thing right now. The sellers had to reapply for the permits for the CO's first, then wait for the inspector to come (which was long) and then you wait for the permits to be OK'd and then the sellers get the CO's. They could hire someone to move it a long quicker, but it costs a lot of money from what I have heard. Each town is different though. Make sure you lawyer is involve a lot and pushes the sellers lawyer to get the CO's done. It's going to take a little while, so be patient if you can. I was dealing with the Town of Bablyon & the Village of Lindenhurst. I hope this helps you. Good Luck!Chat Icon

They are offering a credit of $5K for us to do all this work.

I called the Town of N. Hempstead Buildings Dept. and am waiting for them to call me back to see what kind of $$ we are talking about to get this done.

If it is going to be alot of extra work and time we are going to ask for more of a credit than the $5K initial offer.

My Hubby is an architect and deals with this al the time. I know he has said in order to file for the CO's u need the plans for it and you get charged i think like 3 times the price.

FM if you have some questions I can ask him. He deals with town of hempstead alot

just remember also that your bank may give you a hard time about closing if not all CO's are in place. some will just hold funds in escrow at closing, but some will not let you close at all without all necessary CO's.

call the county clerks office in mineola, they have all land records and will be able to help you more with those really old permit applications. good luck!

Definitely check with your bank to see if they will allow the closing to take place with open COs. We were going to do what you are thinking of, but our bank would not allow us to close with open COs, so the owners had to resolve this.

Also, definitely push things along. It took 9 wks. for North Hempstead to process the CO after the owners had the necessary inspection done. I hope they are speedier with you. We were told they had a backlog of COs.

We had this problem and the seller hired an expiditor and we escrowed the cost of the CO. The seller found out the costs, penalties, etc.

We closed this week and still don't have the CO yet but I'm OK because we escrowed enough to get that taken care of.

If you get a credit make sure it covers penalties and all costs. This could run into the thousands.

Do your research. Just keep in mind that they have a viable buyer and should want to do what it takes to sell this house to you. You have more control than you think.

The bank may not let you close unless they are cleared up--I am a bank attorney for commericial properties and the bank I work with makes all open permits be taken care of before they will allow the loan to close. In addition if you go to apply for the c/os and there is a problem you might have to remove things already done or it may not have been done right and $5k may not cover what you may have to do. I wouldn't close on a house that didn't have all the proper c/os because you can run into alot of problems. I would let them bear the expense and deal with the town and make sure that they move along with the process.

I would get a ton of cash upfront for these issues. This can take a long time and lots of $$$

I work with expeditors all the time and we have an issue now where the building has no valid CO and an even bigger issue is they may need a variance for an atrium that was added since it was a manufacturing zone prior to becoming commercial/retail so the atrium may have to come down or they pay a lawyer to fight the city for a variance.

Dept of Bldg stuff can be a major headache and $$$$. I do have lots of customers who get funds escrowed to cover the expense. The biggest problem is trying to calculate how much to escrow and account for the unknowns.

Like the others have said, check and double-check with your bank that they will even let you go through with the closing without the proper CO's. Do not just rely on the word of your attorney (somebody on here just recently got stuck in the same situation - attorney said it was fine, bank said absolutely not).

Also - since you are not the legal owner of the property, the town is probably going to have to deal with the current owners. Hopefully they are motivated to sell and will move quickly on getting the issues resolved. I'm not sure how much power you have now as just the potential buyers to move things along.

I had to call the Town of N. Hempstead for the same issue. I called Tuesday and haven't gotten a call back. I am going to call them again tomorrow.

I received the call back from the buildings department and they said that I just have to open up the old permits ($70 each) and re-file them then schedule the inspector to come and then they would hand over the CO's.

We are doing this as a flip property. We are not actually going to be living in the house so everything is going to be repaired anyway.
