It depends on the Town. Usually if it is deep or large enough to require a c/o, it will need either a fence or a protective, locking cover.

ETA: in most municipalities, a hot tub is governed by the same rules as pools.

If it is more than 24" deep it is considered a swimming pool in NYS

Call your town- Brookhaven has a link to pool codes on their site

Aren't you in GC? There is no way that would be allowed without a permit or a fence. I had to get my neighbors on all sides to sign a petition just to let me put in an AC unit when we lived there! I would go up to town hall and ask.

what? you needed permission to put an ac unit in your house? Coming from queens, I am amazed at all of these crazy rules.

This was my immediate thought. If you are in GC, not even sure if they are allowed a hot tub. But any town, I would think you need a fence. Call your town asap for safety reasons.

Town of Islip, it's 18 inches to be considered a "pool"...

Thanks I am not 100% sure but my daughter said she saw a pool from her window and it is the size and shape. I know people do a lot of things they aren't supposed to do. They are still doing a lot of work. Thank you. I will look into it more then!
