OMG Great News To Share!!!!!!!!!!
so NJ state just passed this new law on July 1st that allows you to take an ADDITIONAL 6 weeks off to 'bond' with your new baby (state paid)....so that's awesome (as long as your company pays into that specific thing).
well, mine does - and after talking with HR - i found out that my job is not protected for that 6 weeks (they spoke with someone at the state). so they told me - i had to speak with my manager - and if he said it's okay - then HR would not take action and my job would be safe. I heard from my manager today and he said YES!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
i am so excited - i get to spend another 6 weeks with my bunny girl...and now to try and get her on a good sleeping/napping schedule so that i can actually get some sleep to prep getting back to work!!!!!!!!!

Jess, maybe you can help me clarify this new thing. I have heard about it and am very excited because I live in NJ.
But I thought it ran concurrently with your FMLA. From your post, you make it sound like you get an extra 6 weeks on top of your 12 weeks FMLA.
Do you know which is right? Because I would LOVE to be able to be off for 18 weeks instead of 12 when #2 comes along in December!

my HR peeps clarified - it's IN ADDITION...because it can be taken any time during the first year of life of the baby.... if it was concurrent that would not apply.
i think you can take it concurrently if you want to (i guess if you weren't getting enough money or something??)....
my hr peeps told me that i will get a letter from the state when my disability is over and i need to fill out a form DIFFERENT from the others (i think FL2 or something). When i called the state about it - there was an option (automated info) to learn about taking an additional 6 weeks AFTER your pregnancy disability is over - press whatever...

once my time is up - i will have been off for 16 weeks total!

Interesting. I just called my HR department and spoke with a VERY rude woman who had no idea what I was talking about, but she said you can only take off 12 weeks total. Period. I will have to poke around a little more.
ETA: And you mentioned that you take an additional 6 weeks after your pregnancy disability is over. I thought your disability only lasts 6 or 8 weeks depending on what type of delivery you had. So the extra 6 weeks would start after that. Not at the end of your FMLA because that is not disability.

It runs concurrently. It basically entitles you to additional monetary benefits, but not additional leave. This is from the NJ Department of Labor's website:
Must an employee who is taking NJFLA or FMLA covered leave to care for a seriously ill family member or to bond with a newborn or newly adopted child also file a claim for Family Leave Insurance benefits for that same period of leave?
No. The law does not compel an employee to file a claim for Family Leave Insurance benefits at any given time. The law does state that an individual who is entitled to leave covered under the NJFLA or FMLA must “take” any Family Leave Insurance benefits “concurrently with leave taken pursuant to the NJFLA or the FMLA.” This may be misconstrued by some to mean that when an employee requests and is granted permission by his or her employer to take leave from work to care for a seriously ill family member or to bond with a newborn or newly adopted child and where such leave is covered under the NJFLA or FMLA the employee must also apply for Family Leave Insurance benefits for the same period of leave. ETA: Your company though has to offer it, not all companies do though from what I understand. It's not NJ state mandated.

That's great, but it looks like Brooke is right--it doesn't entitle you to any additional leave--

i can only tell you what my HR rep found out after talking with the state - and the info i got when i called the automated system from the state.
