Oh Boy-My tenant

He told us he's moving out.

He sent me a note with his last part of his rent for November on the 20th. I tried to call him several times to see what the story was and he has not returned my call.

My dad called and he picked up and told him he was moving Sat. Today. I have a representative on site there to get the key and perform the inspection. She has knocked on the door and called out to him.

He is very flakey to being with and I'm only happy to see him go but he won't talk to me..won't call us back.

She thinks he hasn't moved yet and his car is still there. Ok, fine just let me know when you are moving and we can get this done.

I hope nothing happened to him. But I really think he's playing games.

He did not give me 30 days notice which is the law so he owes me December rent and he told my father he would pay it but I don't trust him as far as I can throw him.

I'm considering starting eviction proceedings.

Any advice is appreciated here. I'm at a loss.

Eviction proceedings take forever. My mom had a tenant that hadn't paid the rent in YEARS and still couldn't get him evicted. All of the laws are in favor of the tenants, not the landlords.

I don't really have advice, just wanted to wish you luck!

In AZ the laws are different.

They kick them out quick.

I will look into it Monday but why does he have to be such a douche?

If he wants to leave, then leave.

It's very aggravating.

I had to evict someone once. It was annoying, but so worth it. I am glad I began the process as soon as I did, so it was not drawn out. December rent check bounced, I was never paid, tenant was served with papers in the middle of January and by the end of January she was out. Good luck.Chat Icon Chat Icon Chat Icon

Hopefully he won't do what our last tenant did. Leave the keys on the steps of the stairs one morning as a hint he was leaving.

why do people have to act that way. I've been beyond flexible with him.

Who else would let him take almost the whole month to pay rent without late fees?

I just want him gone and I will send him a letter to vacate. After that I will start eviction.

He hasn't called me. I've left over 8 messages for him.

Why even bother calling him? I wouldn't have called him more than 2 or 3 times.

If he told your dad he is moving out, just sue him for December's rent and be done with him. Call the HOA and find out if he really vacated. If he vacated, be happy that at least he is gone so you can rent it out to someone else.

The person who takes care of my condo knocked and he didn't answer. A few hours later he left in his car. His stuff is still there.

I don't know if the HOA would do anything past that.

I'm going to send him a letter and give him 5 days to pay rent and tell me what he's doing. If he doesn't answer I will start eviction.

He's such a weisel.

Oh yes and I'm thrilled he's gone. I even have someone interested in the condo once he's gone. I have no problem suing him.

In NYS you are not legally allowed to keep his security for rent or late fees....Might be different in other states....

Wow so happy your finally getting rid of that loser but I am so sorry you have to deal with him this way before he actually goes. I would start eviction ASAP so he knows you mean business if he is playing games by taking his sweet old time and refusing to respond to you, his landlord.

I really hope your next tenant is a dream tenant. I think you deserve one finally. Chat Icon

This is true and he would have to sue her for the security. But on the other hand if/when he sues, Blu-ize would just countersue for the last month's rent.

So ideally I don't see why not regarding keeping the security deposit.

His measly security won't cover the late fees and damage to the apartment he has yet to pay me.

I have documentation of it all.

I will sue him big time if he even peeps at me about it. He can try to sue me but he will get nowhere.

He owes me months of late fees that total around $3K.

He has $500 security.

AZ laws favor landlords way more than tenants.

I could have done this at any time throughout the lease. He has never paid on time and almost never sent me late fees even though it was stipulated in the lease.
