maternity Leave
I dont know...I assumed that you get at least some paid maternity leave. I havent asked but I read something where it said unpaid. Seems strange since when my dad passed I had paid bereavement. Seems to me that maternity should be paid too.

Re: maternity Leave
Totally depends on what your company policy is. My company did not have a maternity leave at all. I could take up to 12 weeks off (FMLA), but with no pay, unless I wanted to use my own accrued vacation time, which I did.
The only benefit I got was state disabilty, which was $170/week for 8 weeks (I had a c/s).

NOt sure what you mean, get paid and get disability? My company didn't pay me my salary or any portion of it. I just got the state disability. I was out 12 weeks total and I requested that they cash out my vacation time and pay me for thay, which they did.

Re: maternity Leave
I am not getting paid. I will be on unpaid fmla like you. What I meant was that you could get state disability for being out of work on maternity leave? I hope I clarified what I meant.

Yes you can get disability if you don't get paid for FMLA leave. You should ask your HR department how you go about applying for it.

Re: maternity Leave
I work for a small office so there is no maternity leave pay given. I will apply for state disability and get that for 6-8 weeks depending on what typeof delivery I have, and I will also use vacation time I have acrued and not used yet through my job.

Same thing here, except I only got 5 weeks short term disability!

Re: maternity Leave
Okay, lets say I stay out for 3 months and only have 4 weeks vacation. Do I apply for state disability for full 3 months or 2 months due to using my vacation time?

I could be wrong, but the state disability will only pay you for 6 or 8 weeks depending on your delivery (vaginally or c/s). Short term disability is something that might kick in if you were to be medically necessary for it, and I think to be eligible, you need to be out for 3 months or more and have a docs note saying you are medically unable to work.

That is true, everyone only gets 6 or 8 weeks disability pay. My company did not pay me either so I could a whole $800 after taxes for disability.

you should check your disability with your insurance. Mine is full paid, for 6-8 weeks, then my job offers maternity leave for 6 weeks then you can use 10 vacation days, so really you get 14 weeks.
You said you don't get the maternity leave, but maybe your insurance gives you short term disability.

well, all disability policies are different. Mine kicks in after 7 business days of being out, with a Dr.'s note. And, I think it is a little different for post partum (sp?). I was told it kicks in immediately.
