Lets talk about termites!
Yes what a wonderful topic
In the inspection, abandoned termite tubes and termite damage was found in the house. In addition to the engineer, we had a guy from terminix come in and he said the house looked like it had never been treated, but he couldn't see any current activity - especially because there were walls up in the garage and paneling in the basement... so is there anything we can do to get the sellers to pay for a treatment or are we out of luck because there is no observable activity?

When we had our new house inspected last month, the engineer found ONE single mud tube, no signs of any live termites or anything...and we were able to get the homeowners to pay for treatment (Terminix: it was over $1,000). It doesn't hurt to ask!

absolutely, it should be added to the contract that the owner pays for the treatment or you receive the discount. If there is tubes found then termites once lived there. Its gross but DH has worked with on a house that had the tubes but no activity.

When we purchased our home, they found traces but nothing live in the term of termites. We had it added to the contract that the sellers MUST pay & they did!!!

It depends on what the contract calls for. Most times the contract will state that unless there is "active" infestation it is considered no infestation and it is up to the buyer at their own cost and expense to repair the damage.
Honestly, though many times termites inspections are done after contract signing so buyers aren't aware of damage, prior infestation and such. But you can probably have the contract wording worked out prior to your execution.

After our engineers report, they found termite damage in the garage. The homeowner paid to have it treated. After 7 months in the house, we got a sworm of termites in the kitchen and living room. Different spots than before. We paid for terminix to install their system. It costs $2000

so they only treated the areas where the damage was, not the whole house?
