DH thinks I'm crazy because I'm always saying certain actors in commercials are intentionally made up to look like stars. I knew I wasn't crazy!!
There's a commercial for something (don't remember what, we watch with mute on) and this guy was getting a haircut and looked exactly like the actor who plays Mark Zuckerberg in The Social Network.

Is the issue that she *looks* like Kim ( which she doesn't really IRL), or that Old Navy *styled* her like Kim, which they clearly did? The fact that this chic doesn't really look like her when she isn't made up, makes it even more obvious that ON was doing this on purpose.
Also, she is sueing ON (which is still a stretch), not Melissa Molinaro.

If I had to bet the theory they are suing under is brand dilution which means that there likely is confusion for the general public between an advertisement for product X by person or company Y. Kim is likely alleging by having someone who looks or is styled in her unique way gives an impression that she and her brand are giving her/its endorsement of old navy without her permission.
I will say that when I originally saw the advertisement I thought they had Kim in the add so her law suit has some merit on its face.

I think her lawsuit has some merit. They clearly depicted a KK look alike on that add. I mean EVERYBODY knew exactly who they were trying to portrait. The actress/singer is not at fault. ON is!!!!

I agree.
It seems they wanted her associated with ON somehow, but didn't want to dish out the $$$ to use her in the commercial. At least that's how I see it.
