IVF and taxes - another question
Our total adjusted gross income is too high to claim any deduction for our medical expenses. But, does anyone know, if we decide to file separately this year, can I claim the IVF medical deductions against my salary only? Is there any rule against doing this?

I'll ask my DH tonight how we did it last year. I think we were too high also, but then we figured out a way to get it in there. And I'm not sure if the whole amount is deductible or just the amount that is over the percentage I'll get back to you

No, I know we can only deduct any medical expenses that exceed 7.5% of our AGI, but with our combined income, we make too much to even deduct ANY of the amount. If I were to file married, but separately, and apply the deduction only to my income, then I would be able to deduct a good amount of what I paid for all the IUI's and IVF we did. I'm just wondering if this is a legal option. I suppose I'll discuss it with our accountant when the time comes...

I believe there are some restrictions for itemized deductions when married filing separate. Although I'm not sure what they are, your accountant is your best bet.
