Is this legal?
My brother lives in a co-op and he received a letter from the co-op Board that they have bike room and the charge to store the bike is $5 per month. The letter also states that if you opt not to store your bike in the bike room, you can not store it in your apartment and take the bike in and out of the building. (The bike room has an outside entrance/exit)
My brother has 3 kids so it would be $25/month for his family to store bikes. He currently stores the bikes on a hook on the back of his SUV. He was told he can no longer to that.
Can the co-op Board enforce such a rule?

Re: Is this legal?
Yes of course. Coops have a lot of rules, most good but some are very inconvenient!
They do vote as a board to change/ add rules when needed

Re: Is this legal?
Unfortunately, the co op can change rules and add fees after a board meeting. Did they give proper notice? I would guess they are arguing that the bikes in the hallways are wearing down the carpeting faster than people walking on the carpeting as their rationale for in posing the fee.

co-op's have lots of rules and can pretty much make them up as they please. Its the reason most people will not buy in a co-op

His wife was left the co-op by her grandparents. It's 3 bedrooms and up until now they had no complaints. My brother is annoyed b/c the bike room is adjacent to the garage so he would be leaving the same way. They don't store the bike in the co-op itself.
The letter was a form letter that the entire building received. But on his there was a handwritten note- "It has come to the Board's attention that you are storing the bikes in a garage. Please note that this is not an acceptable solution and in violation of the rules. If you continue this illegal storage method you will be charged $5 per bike per month and $5 per month, per bike for the violation of the bike storage rule."

Re: Is this legal?
Thats crazy that he cant keep them on the back of his car! Co op's can basically do whatever they want though as long as the board approves.

Re: Is this legal?
I really don't understand how they can possibly dictate what he can and cannot keep ON his car if it's attached properly. Or what he stores inside his unit. But co-op boards can apparently get away with pretty much anything. It's insane.
Even if they can't technically do this, what recourse does he have to fight the charges? Who is he going to complain to? He could try but it will be more trouble than it's worth and that's why they pull this nonsense - they know they can get away with it.

Re: Is this legal?
I would do everything in my power to shove those bikes INSIDE of my SUV and store them in there.

That stinks! Not the same thing but I live in a rental building that has bike storage as well. We own 5 bikes (and store them all in our 1 bedroom apartment) and the last time we had work done in the apartment, the super told us we need to pay for storage and not have our bikes in the apartment, and that would cost an extra $50 a month. We have refused and nothing has been done about it but I'm sure he's in a different situation and wouldn't want to be in bad standing with the co-op board.

Completely legal. I'm on a board and you have no idea the ridiculousness of people. This new rule might seem crazy but I guarantee somethings have been preceding it causing this rule to go into affect

This exactly. Someone may have damaged walls, carpeting, doors while taking bikes out, may have hurt someone or my favorite, "inconvenienced" another shareholder. People are azzhats which is why being on a board is oh so much fun. Any new rules affect directors as well and I have challenged a lot of potential new rules as being unfair to a majority of shareholders. It's a lot of money for 5 bikes. I would question whether that amount could be discounted especially during months when the bikes will not be taken in/out. Is the co-op supplying a safe and secure storage area or is it just an open room ?
As far as the garage, that spot has its own occupancy lease and regulations regarding storage.
