I am so MAD right now- I can't even think
About ago DH was forced to crash into another car (he was slowing down, inthe middle of the Northern State with no traffic and then finally stopped dead)
the oldest scam in the book
no damage to either car- besides the rainbow of prior damaged as noted by the police officer - who thought it was a set up - like my DH
today I get a letter from his lawyer that he is suing me for "personal" injuries
All State is going to fight this- and I really hope they get this guy for Fraud!

The scams defraud the insurance companies by claiming injuries and going to "doctors" that are associated with the scammers.
I hope your insurance company straightens it out fast!

same thing happened to me several yrs ago. I got sued for a million dollars 
MEANWHILE - they guy I hit was the only one able to drive away from the scene of the accident. it was a 10 car pileup. I was hit from the rear - and so on. the guy refused medical attention at the scene but claimed he lost wages due to injuries  
I went to court with my Allstate assigned lawyer and gave a deposition. NOTHING came of it! and I'm sure nothing will come of this either

i was in a similar situation years ago - got notified in the mail that I was being sued for $1,000,000 (yeah, okay)
got thrown out faster than you could say 'what a jerk face'

Same thing happened to a girlfriend of mine.
The insurance company squashed that real fast!

thanks everyone!
My Dad and DH said the same thing- that this was too be expected- and that it wont be a big deal
it just makes me mad to know what my DH has gone thru with his massive neck injury and I am thankful this jerk didn't reinjury his bone graft- it was only 3 and 1/2 months old!

Happened to me too - a kid hit me when it was raining heavily and drove away fine - another car followed him afterwards, which i should have found fishy. My mistake was not calling the cops since it was in a residential area and I believed he was fine since he said he was. I got papers that I was being sued for the max of my personal injury coverage when the insurance company (we had the same company) refused to pay because the guy wouldn't release medical bills as documentation of his injuries.
It all got settled - the insurance company finally paid the claim, but my insurance went up since I had a stop sign and he didn't. I still believe it wasn't my fault and was a total setup, but had no proof. I will never hesitate to get a police report now.
My brother was also in an accident where there were 3 people in the car and when they sued, suddenly there were 4 people. Too bad the police report said 3! I think this stuff is sooooo common.

The insurance companies seem to be aware of this situation so hopefully it will all work out ok.

I have a friend who works only with Car ins. fraud cases - She says 9 x out of 10 they're thrown in the garbage b/c they're laughable -
I'm sure yours will be one of them -

Make sure you notify your claim rep that this was intentional on behalf of the other vehicle and ask them to have their SIU review it (SIU handles the fraud cases).

You have Allstate? If so, then don't worry. From what I know, Allstate takes 99% of their cases to trial. Chances are that either this guy won't hold up until they go to trial (which most likely won't be for another year or so) or his lawyer will drop him because he doesn't meet the threshold limits.

Yes! I love Allstate- I just got off the phone with the adjuster- she totally agrees with me
they are researching his record- at first his name was spelt wrong- so she ordered the police report and got the correct spelling
she is putting his company on notice today that they think this is fraud
she said if that doesn't stop it- she will order an indepdent review of his injury
I like- she is a tough cookie!
