I am LIVID
I was pulled over and given a ticket for using a cell phone and I didn't even have my cell phone out. I'm so angry I really coild have pulled a Zsa Zsa with the cop. How the heck am I going to dispute this? I feel so helpless.
The only thing I can think I could do is show my bill with proof I was not on the phone at the time I was pulled over.

How the heck did he justify that???
Yeah, get a detailed bill from your cell phone which will show when it was used last. The cop probably will not show up to court. Plead "not guilty". Did you say, "uh, my phone was not even out?"

That's what I don't get. There are oodles of people actually using cell phones while driving, why give the ticket to someone that wasn't using one.?

I don't get it either, sounds like you could easily prove him wrong by doing this!!!!

I know it sounds strange. I think he was trying to pass me and I didn't realize it. I wasn't looking in my rearview mirror. He says "I know you were using your cell phone"

I can't tell you how many people I see a day with their cell and driving. But if you weren't on it, by all means show your bill. That should get you out. Sorry you have to go through this!

I would show the cell phone bill. Honestly, if they want to contest it that badly they would have to search to see if you have another phone # I would think, that could have been on you that day.....

Thanks. I feel a little better. At least it was in NJ and I won't get points on my license. This is the first time I have had a run in with the police like this. I feel awful for the people who have been through so much worse and the cops don't believe them.

Wow, same thing happened to my Dad.
The Police Officer was like "I know you were on your phone" and my Dad was like "what?!?!" (lol) so he goes "no, really, I swear I wasn't" and the guy gave him a hard time so my Dad thought, why am I arguing?
So, he just showed him his badge- which normally he would have done sooner but he was so taken back at the fact that he wasn't even breaking the Law and doing what the Office said he was that he was stunned...
So, he shows the badge and the Officer goes "Oh, OK no problem" and my Dad goes "but REALLY, I wasn't on the phone"
The Officer left and that was that-- he would have definitely given him a ticket if my Dad was not a retired PO.
I'm SO sorry!!! That's sad that the PO made such a big mistake like that.

W T H??? that makes me SO angry and what's to stop any cop really from doing that? how can this jerk be so immoral?!
like someone else said, call your cell provider if you don't get an itemized bill and ask for it. I have every single call DH & I make printed out with my bill - time & date stamped! that will get you out of it!
